AIMS AND CONTENT

LEARNING OUTCOMES

Course description

The course will primarily intended to regulate domestic and Community legislation on the protection of competition, with particular attention to the processes of socio-political formation of the modern legal systems for monitoring the agreements and conduct restricting competition and the competent authorities. Will also be given wide space to the comparison with jurisdictions that have a tradition of antitrust legislation is particularly interesting, as the U.S. legal system and the German one. In addition, we will investigate some areas where market regulation acts as a tool of particular relevance for the provision of efficient services.

TEACHING METHODS

Part I: The first part of the course is devoted to the analysis of the general principles relating to freedom of competition, consumer benefit and State intervention in the economy. It also will emphasize those which are the main distinctive points of our national systems for the protection of competition in comparison to similar points of Community and certain foreign legal systems .

Part II: The second part of the course focuses on the analysis of EC antitrust law, considering the articles of the TFEU , Regulations , Directives and Communications Community bodies which implement and clarify the scope of application of this legislation . Ample space is given to the analysis of the jurisprudence of the Court of Justice and the Commission's practice .

Part III: The third part is devoted to the consideration of the law of unfair competition and antitrust law Italian , regulated by the rules of the Civil Code and , primarily through antitrust law n . 287 of 1990

Part IV: The final part of the course is devoted to the illustration of the fundamental elements of the systems of market regulation of postal services, telecommunications , energy , networks of companies and innovative start- ups  .

ASSESSMENT METHODS

Oral Examination The examination is for students who attended for those not attending , takes place in oral and takes place at the end of the course. Not be made midterm , but the result of the exercises will be evaluated with a score that will be a surplus with respect to the examination mark awarded . The exercises , which will take place in the classroom into the working class tend to check the students' ability of understanding, reasoning and exposition , without implying the necessity of thorough study and overview of the subject.

The assessment by the teacher in the examination will take into account , as well as preparation of the student , even the elements resulting from its participation in seminars and exercises in the classroom . The inquiry will focus on the entire program and will consist of three questions, on three different areas of the subject matter.
