The aim of the course is giving an overview about common law legal systems, with a special focus on the U.S. sytem and international criminal justice, particularly referring to International Criminal Court.
Comparative analysis of adversarial and international criminal systems. Study of US criminal procedure, with special focus on relations between adversarial proceedings and negotiated justice. International Criminal Court proceedings.
Frontal Lessons
The first part of the course is dedicated to the comparison between the Italian Code of Criminal Procedure and the U.S. system, starting point not only for the internal reform of the adversarial system of 1998, but also for further emendaments. In particular during the course the teacher will analyze negotiated justice mechanisms (plea bargaining).
The second part of the course is dedicated to international criminal jusice, with a special focus on the International Criminal Court. The course will be integrated by a lesson on legal reaserch methods.
