OVERVIEW

The EU Law course analyses the institutional structure of the Union, the sources and characteristics of EU law and the Single Market discipline (4 fundamental freedoms and competition rules). All information about the course can be found on the aulaweb page. Communications to students are made via the forum on the aulaweb page of the course.

AIMS AND CONTENT

AIMS AND LEARNING OUTCOMES

The programme is divided in two sections: the first part is devoted to the analysis of the institutional aspects of the EU, featured by the study of the structure of the international organisation, sources of law and jurisdictional protection; the second part is centred on the discipline of the internal market and other EU policies, characterised by the study of the main principles and the main case-law of the ECJ which contributed to the development of Eu law.

Teaching aims:

- knowledge of the institutional structure and EU procedimental rules;

- knowledge of the system of EU law sources;

- knowledge of the single market rules;

- ability to re-elaborate the principles and rules under consideration and to apply such knowledge to actual cases;

- ability to interpret and systematically construe the legal rules.

TEACHING METHODS

Teaching is offered by lectures directly held by the Professor (60 hours), during which the main notions of Eu law will be analysed in light of relevant case-law pf the ECJ. The calendar of the lectures and further materials will be uploaded on Aulaweb.

During Lectures sessions which will involve the active aprticipation of students will be scheduled, mainly within the second part of the teaching,. Students will be given decisions of the court to be analysed and presented to the class.  During those sessions the lecturer will build the lecture upon the considerations and analysis offered by the student.

The EU structure; Relations between the EU and the Member States; The EU Institutions; The EU and  international law; The formation and implementation of EU law; The judicial system; European citizenship; Fundamental rights and freedoms; Internal market; Competition rules for companies and states; other Eu Policies (particularly with reference to technological development and space); otline of monetary policy .

EXAM DESCRIPTION

Oral exam during the session. Students who attended at least 2/3 of lectures will be given the possibility to take a written test before the beginning of the session. It will comprise a multiple choice test of 30 questions (ad es.: Quale tra i seguenti non è uno Stato membro dell’Unione europea? : a) Danimarca, b) Svizzera, C) Croazia, dove la risposta corretta è quella alla lettera b), and an open question on the topics deepened during lectures (ad. es: Il candidato analizzi la libera circolazione dei lavoratori nell’Unione europea, facendo opportuni riferimenti alla giurisprudenza pertinente analizzata nel corso delle lezioni).

ASSESSMENT METHODS

The exam is aimed at the confirmation of the knowledge of theorical notions as well as of students' capabilities of identifying and applying relavnt rules to cases. Throughout questions with a theorical and practical feature and the proposal of a concrete case the Professor will verify if the student is able:

  • to identify and to define relevant juridical concepts of the EU;
  • to use a proper technical language;
  • to identify and to apply to concrete cases the rules of EU law;
  • to know the main rules concerning the functioning of EU institutions and relevant inter-institutional mechanisms;
  • to know the scope of application and featutes of Eu law acts and their relationship with national legal orders;
  • to know jurisdictional protection mechnaisms in force within the EU
