OVERVIEW

The Course will be mainly focused on contract law,  with a glance at some rules within the field of legal obligation

AIMS AND CONTENT

LEARNING OUTCOMES

Students are expected to manage with critical attitude some main topics of contract law and the law of obligation.

The course aims to analyze and discuss some main controversial topics of Italian contract law.

PREREQUISITES

Students must have passed Diritto Privato I and II

TEACHING METHODS

Lectures and class participation.

If the sanitary emergency will be persisting, I will have recourse to blended lessons

SYLLABUS/CONTENT

The Syllabus will be published in aula web before the starting of the class.

The content of the course is the general part of Italian contract law (articles 1321-1469 Italian Civil Code, with reference to some other specific statutes on contract law), and an analysis of the concept of legal obligation

I) On the law of obligations: Adolfo di Majo, Delle obbligazioni in generale, nel Commentario del codice civile Scialoja-Branca, Bologna-Roma, Zanichelli-Soc. ed. del Foro Italiano, 1988 (La struttura dell'obbligazione; Comportamento secondo correttezza; Dottrina e prassi sul principio di buona fede; Il significato della regola sulla diligenza), ca. 148 pages: the parts of the volume that are the subject of the program will be made available in pdf format and uploaded in the web classroom of the course.

II) On the law of contract:

i) Luigi Balestra, Introduzione al diritto dei contratti, Bologna, il Mulino, 2015 (pagine 250: tutto)

ii) Vincenzo Roppo, Il contratto del duemila, IV edizione, Torino, Giappichelli, 2020 (pagine 177: tutto)

The exam will be focused on the written skills of the students in the construction of a legal argument related to contract law.

The exam is written (10 open questions: 3 points for each question).
