OVERVIEW

The course consist in an in-depth study of topics concerning private and procedural international law

AIMS AND CONTENT

LEARNING OUTCOMES

The rules on the conflict of laws: general issues; problems arising from “renvoi”, foreign law’s knowledge, public policy, mandatory rules, etc.; the recent EU Regulations on the law applicable to contractual and non-contractual obligations, and to family matters; the rules on jurisdiction and on the enforcement of foreign judgments; the Italian rules of Law of 31 May 1995 No 128 and its recent amendments

AIMS AND LEARNING OUTCOMES

The course will give students knowldege in free movement of judgments, international jurisdiction, applicable law to cross-border cases. Students will comprehend i) principles and main rules of private international law, in particular related to the domestic act of PIL; ii) limits to domestic jurisdiction in light of EU and international law; iii) functioning of conflict of laws rules to determine the applicable law; iv) recognition of foreign judgments. Particualr attention will be given to the residual scope of application of domestic provisions of private international law following the adoption of numerous EU Regulations.

Knowledge acquired by students will allow them to better fit international professional arenas. The subject is also foreseen in the diplomatic carreer access exam.

 

PREREQUISITES

Basic knowledge of International Law and European Union Law is required.

Frontal classes with text and case law material analysis (uploaded on aulaweb). Seminars might take place during classes with the teacher with experts of the subject matter.

Scope of application of the Italian PIL act

EU intervention in PIL after the Amsterdam Treaty in 1997

Scope of Italian jurisdiction in light of domestic, EU and international law

Coordination ofn EU law and domestic law

EXAMS

EXAM DESCRIPTION

Online channel code: l1buonj

The exam is oral, and held in Italian. It usually consists of 3 questions on topics of the programme. To give the exam, the student must enroll to the exam session via the internet portal. 

To students taking part to 2/3 of classes, it is given the possibility to give a written test at the end of the course, which consists of multiple-choice questions.

 

ASSESSMENT METHODS

The exam will verify the acquisition of competences, legal reasoning and thinking, as well as the acquisition of proper legal terminology.
