On the one hand the course analyzes the relationship between the religious factor and the political community in the contemporary age, with particular attention to the Italian case, and on the other the religious phenomenon in law through models of comparison and relationship between religions, culture and legal system in Euro-Mediterranean area, with particular reference to specific problem areas concerning the institution of marriage and the function of ministers of worship
Objectives of the course are: 1) the study of the religious phenomenon both in the inter-disciplinary dimension and in the institutional dimension, in order to deepen the theme of the sacralization of politics and of the nationalization of religion in the Italian legal system and in other systems; 2) the critical analysis of the relationship between religions, culture and law of the Mediterranean area, referring particularly to specific common institutions such as, for example, family, ministers of worship, finance, food rules in order to identify them, through an analysis of comparative type on a historical-juridical basis, analogies, differences, problematic aspects, modalities of performance in particular analyzing single institutions common to Catholicism, Islamism and Judaism.
At the end of the course the student will have to know, describe, understand, analyze the dynamics between the religious factor and the political community and the manifestation of the religious phenomenon in law through the models of comparison and relationship between religions, culture and legal system in the Euro Mediterranean area
In this regard, the attention is concentrated in the public space of Christianity, Judaism and Islam, deepening the analogies and antinomies concerning the religious institutions examined and casting a glance on the meaning of the law of religions, on the main sources of religious rights and on the related methodologies of study. During the course will be held in-depth credit seminars, oral or written exercises with optional distribution of the related material through insertion on aulaweb, which may replace or integrate parts of the program, to be agreed with the teacher.
