CODE 104858 ACADEMIC YEAR 2021/2022 CREDITS 6 cfu anno 1 RELAZIONI INTERNAZIONALI 11162 (LM-52) - GENOVA SCIENTIFIC DISCIPLINARY SECTOR IUS/14 TEACHING LOCATION GENOVA SEMESTER 2° Semester MODULES Questo insegnamento è un modulo di: EU LAW AND MIGRATION LAW TEACHING MATERIALS AULAWEB OVERVIEW Aim of the course is to deepen the studying of the most significant global challenges of this era and, among them, in particular, the one concerning migration issues through a multilevel legal perspective, which considers the legal framework of EU law and the solution adopted for its adaptation in the Italian legal order as well as in some of the European States. AIMS AND CONTENT LEARNING OUTCOMES At the end of the course, students will acquire advanced knowledge and methodological competences in specific areas of EU law dealing with cross-border and international challenges; will understand complex legal situations, and will have the means for critical independent legal thinking and propose innovative solutions. AIMS AND LEARNING OUTCOMES The "EU law and global challenges" module aims to provide students with the methodological tools and notions necessary to understand, contextualise and analyze the role of the European Union as a global actor and the scope of European Union law (also) outside the European system. Both profiles will be considered in relation to global issues, such as the protection of the environment, the use of the internet and the protection of personal data, the economic and financial crisis, the protection of competition, as well as the migration phenomenon. LEARNING RESULTS At the end of the course students will be able to understand and critically evaluate: • to understand the role of the European Union as a global player • to understand the extraterritorial scope of European Union law • to understand and critically assess the exercise of the external competences of the European Union with respect to global issues • to navigate the European migration discipline; • to navigate in the complexity of the migration discipline as a multilevel phenomenon (European states, EU, ECHR) • to understand the main problems of Italian legislation and case-law and those of other European and non-European states • to critically discuss on the fundamental rights of migrants • to evaluate the impact of the migratory phenomenon in state systems • to express oneself through technical terms typical of legal language TEACHING METHODS Traditional frontal lectures will be supported by the use of PPTs. Students will be involved in the discussion of case-studies and specific topics. Students attending at least 75% of classes will be examined with i) discussion of the topics; ii) written test, and iii) sPPT presentations. Competences can also be assessed during oral exams. During the pandemic and post-pandemic period, lessons will take place according to the instructions provided by the University and the Department. SYLLABUS/CONTENT The course, held in English, deepens the study of how the European Union legal order tackle some of the existing global challenges. More precisely, the first module (EU law and global challenges) will focus on the following topics: • European Union and European Union law in the global context • European Union law and the environment • European Union law and protection of personal data in the use of the internet • European Union law and the economic and financial crisis • European Union and competition law • European Union law and migration phenomenon The second module (Migration law) will be structured as follows: RECOMMENDED READING/BIBLIOGRAPHY EU law and global challenges The following book is recommended: M. Students are usually asked three questions on topics of the programme.
