OVERVIEW

The course will tackle topics of diplomatic and consular law. Main focus will be international and European Union source of law.

 

AIMS AND CONTENT

LEARNING OUTCOMES

By the end of the course, students will have acquired the methodological tools and specific, advanced skills of diplomatic law (international and European), will be able to understand and analyse current legal issues in diplomatic relations and will be able to develop autonomously and critically possible solutions to open questions.

AIMS AND LEARNING OUTCOMES

The course aims at the acquisition of specific competences in the field of diplomatic and consular law, through the study of the rules existing at the international and regional level. In this context, students will acquire the necessary knowledge in order to comprehend and operate with the main rules governing diplomatic and consular relations and functions as codified in international instruments and developed in the practice. Particular attention will be given to topics such as immunities, diplomatic and consular protection, also in light of the most relevant case law. Particular attention will be given to the European Union as diplomatic and consular actor in the post-Lisbon treaty era.

PREREQUISITES

Basic knowledge of International Law and European Union Law is required.

TEACHING METHODS

Teaching is given in person.

In accordance with the rules on access to university premises that will eventually be adopted to combat the spread of the pandemic by COVID, lectures may possibly be conducted on TEAMS. If necessary, the TEAMS code will be communicated via aulaweb.

Didactic materials are uploaded on aulaweb. Students are encouraged to sign in in the webpage. For topics and methods, the course wishes to stimulate active participation from students, who are invited, under the supervision of the teaching staff, to present cases and problematic issues

SYLLABUS/CONTENT

The course deals with i) origins of diplomatic and consular law; ii) establishment of diplomatic and consular relations; iii) diplomatic and consular functions; iv) diplomatic ceremonials; v) diplomatic and consular immunities and privileges; vi) EU external action service.

EXAMS

EXAM DESCRIPTION

Oral exams take place in person. It usually consists of three questions on topics covered during classes (or on topics covered by teaching materials for students non attending classes).

If different indications are given by the University or DISPI, due to the Covid-19 pandemic, exams may eventually be held online (TEAMS code will be communicated in Aulaweb).

Students taking part to in-person classes 8at least 2/3 of the lectures) will have the opportunity to do a written exam (instead of the oral) at the end of the course. This usually consists in 30 multiple choice questions, and possibly an open question.

 

ASSESSMENT METHODS

The exam will verify the acquisition of competences, legal reasoning and thinking, as well as the acquisition of proper legal terminology.
