AIMS AND CONTENT LEARNING OUTCOMES The teaching aims to explain to students the main issues of public law, among which: the sources of Italian law, also in relationship with supranational sources, Italian State, its powers and its territorial organization, the protection of human rights. These issues will be analyzed in order to point out the features more related to sport, with a mainly practical approach, so that students will be able to: find, read and understand the normative acts regulating sport, learn the legislative, administrative and jurisdictional competences about the manifestations of sport, know the rights that come into relief in connection with sport and the limitations of them which are legally provided in order to guarantee the correct performance of sporting activities, especially of the agonistic ones. AIMS AND LEARNING OUTCOMES The teaching provides a foundation to facilitate the study of the other legal subjects included in the course offerings of the degree program. Upon completion of the study of the subject matter taught, students will be able to achieve the following learning outcomes: 1. Knowledge and Understanding: Student(s) will be able to describe and explain the fundamentals of public law after attending lectures and studying the materials indicated by professor 2. Ability to apply knowledge and understanding: Student(s) will be able to apply the acquired knowledge to solve practical cases related to the interpretation of public law during exercises and examinations 3. Autonomy of judgment: Student(s) will be able to critically evaluate complex legal situations using acquired knowledge independently, in both academic and professional contexts 4. Communication Skills: Student(s) will be able to use the technical language of the discipline to communicate clearly with specialist and non-specialist interlocutors, both in oral and written form 5. Ability to learn: Student(s) will be able to independently explore the main issues of the discipline using legal sources and case law related to the field of sports PREREQUISITES No prerequisites are required. TEACHING METHODS The teaching will consist in frontal lessons held by the professor in presence; some lessons will be held by other professors or experts invited to deepen particular topics. SYLLABUS/CONTENT After outlining the notion of the legal system, supranational systems and Italian State system, including its territorial articulation, the teaching will examine the following topics, with specific regard to profiles relevant to sports: the sources of law, public administration, the judicial function, the rights and duties of individuals; sports associationism. RECOMMENDED READING/BIBLIOGRAPHY The exam should be prepared, in addition to the material that will be uploaded on Aulaweb platform, on the following texts: Piera Maria Vipiana, Elementi di diritto pubblico e amministrativo in relazione alle attività sportive, Pacini editore; Francesco Dal Canto e altri (ed), Il diritto dello sport dopo la riforma, Pisa University Press, 2022, chapters 1, 2 and 3. Class schedule The timetable for this course is available here: Portale EasyAcademy EXAMS EXAM DESCRIPTION The examination will consist of several questions aimed at testing students' knowledge of the topics in the syllabus and legal argumentation skills. The teacher's evaluation will be based on the level of knowledge of the subject matter and the ability to evaluate legal issues and legal argumentation. For FREQUENT students only, an OPTIONAL written self-assessment test, including closed and open-ended questions, will be held in December. If successful, the student will have to take a reduced oral test (1 question approximately). More information will be provided during the course. ASSESSMENT METHODS The Examination Committee will assess the completeness of answers, ownership of language, and the ability to make connections between the various parts of the subject. Specifically, the assessment of teaching knowledge will take place through students' responses to open-ended questions that require them to: 1. Knowledge and Understanding will be assessed through oral examination questions on the main institutions of public law, requiring Student(s) to recall and distinguish key concepts. Ongoing assessment will take place during lectures through the review of previously covered material. 2. Ability to apply knowledge and understanding: the oral examination will include the analysis of a case concerning the relationship between the sports legal system and the state legal system, with particular attention to analytical skills. During classroom activities, the professor will involve Student(s) in the discussion of a case concerning the relationship between legal systems, encouraging exchange among participants and feedback to him/her. 3. Autonomy of judgment: Student(s)’ ability to evaluate complex legal situations will be assessed during the oral examination. Judgement skills will be developed and assessed through in-class discussion of relevant issues. 4. Communication Skills: the evaluation will consider the appropriate use of legal terminology and the development of communication skills over the duration of the course. 5. Ability to learn: Assessment will focus on the ability to develop legal solutions to complex issues in public law in the field of sport. Evaluation criteria include completeness, correctness, clarity of exposition, critical ability and connection with general principles of law.
