To achieve the capacity of managing criminal law isuues through the principles of criminal system and of common law
Lectures
Functions of sentence. Criminal law and Constitution. Principles of materiality, of offensivity. Structure of offence: actus reus, mens rea, justifications. Distinction between crimes and contraventions. Actus reus: analysis of action, omission, chain of causation. Singles justifications: legal order, necessity, self defence, exercise of right, consent by rightholder. Mens rea: intention, recklessness, negligence. Shapes of crime: attempt, concurrent offences, circumstances, participation. Criminal sentences and preventive sanctions
