AIMS AND CONTENT

LEARNING OUTCOMES

The subject will aim at equipping participants with the essential contents, as far as legal principles and norms are concerned, with regard to international and European tourism law. It will include as a consequence an analysis of the principles and the instruments of international law applicable in the area, with some elements of international organizations, as well as of the main instruments of European Union law, both of a general and sectoral scope of application. Some introductory notions on the system of the sources of law of the concerned legal systems will be provided.

AIMS AND LEARNING OUTCOMES

This course is aimed at providing students with an adequate knowledge and understanding of the principles, norms and main trends that are typical of the international and European tourism law. In this vein, the system of the sources of international and European Union tourism law shall be analysed. Specific attention shall then be devoted to the specific contents of international and European Union law instruments in this area. In addition, the main forms of international institutionalized cooperation in this field shall be dealt with along with the role of the European Union. In examining this area, students shall be constantly encouraged to enhance the relationships with other domains of international and European Union law (including environmental law, international trade law and transport law). In particular, students will gain basic knowledge in the following topics:

1. Sources of international and European Union law.

2. Structure and activity of the main international organizations involved in tourism governance.

3. Tourism and environmental protection.

4. Tourism and protection of landscape and cultural heritage.

5. Tourism and European Union internal market.

7. European Union visa policy and consular assistance of European Union citizens abroad.

8. Europan Union and international law of transport of persons.

9. Tourism and European Union consumer law, with particular reference to the discipline of “travel packages”.

 At the end of the course, the student is expected to:

  • Know the sources of international and European Union law and their relationship with the domestic legal order.
  • Understand and report on the functioning and activity of the main international organizations involved in tourism governance.
  • Know and report on the content, inspiring principles and goals of the international and EU norms concerning the protection of environment, landscape and cultural heritage.
  • Know and report on the content, inspiring principles and goals of European Union fundamental economic freedoms and of material policies studied during the course.
  • Analyse legal questions and indetify the international and European Union rules applicable to them;
  • Use adequate technical language when reporting on the topics studied during the course, both in the oral and written form.

TEACHING METHODS

The course consists of 36 hours of lectures. It is held in Italian and is based on the exam in the classroom of the main legal instruments that exist in international and European Union law. During the lecturing period some practical cases will also be examined with a view to conduct focussed discussions to which students will be required to actively participate. Teaching materials will be made available on the University portal www.aulaweb.unige.it. For a better organisation of the teaching activities students are required to register on the website as soon as possible. In order to facilitate the discussion, the calendar of the lectures will be published in advance and all relevant documents will be uploaded on the University portal.

1. Introduction. Sources of (international and EU) tourism law.

2. International organizations. The World Tourism Organization. The role of the UN, the WTO and the World Committee on Tourism Ethics.

3. EU tourism law, in general and with regard to freedom of establishment, free movement of workers, freedom to provide services and competition rules.

4. Tourism and environmental protection in international and EU law.

5. Tourism and the Landscape Convention.

6. Tourism and the protection of cultural heritage in international law.

7. Tourism and the EU visa policy.

8. Tourism and consular assistance of EU citizens abroad.

9. Tourism and international and EU law of transport of persons.

10. Tourism and EU consumer law. The EU travel package directive.

EXAM DESCRIPTION

For regularly attending students (at least 75% of the lectures) the verification of the knowledge acquired shall be verified through classroom discussions on assigned topics and a written or oral test based on multiple choice and/or open questions. Such results may be further verified on the occasion of an oral exam. Non-regularly attending students will have to pass an oral exam. The examination panel shall be designated by the Department Council and shall be chaired by the course holder. The duration is, normally, of 15 minutes and the exam is based on the discussion of at least three different topics.

ASSESSMENT METHODS

The presence of the students in class shall be verified by requiring a signature or by roll call. Both in the oral and written exam, the assessment aims to verify the knowledge of the topics studied during the course, as well as the capacity of the student to conduct critical analysis and apply the relevant norms to practical cases. Tools for performance evaluation will include, besides the knowledge of the relevant contents, the quality of the exposition, the use of adequate technical language, the capacity to develop a critical analysis of the topics.
