AIMS AND LEARNING OUTCOMES

Teaching's aims (in detail)

The teaching aims to:

- introduce to the knowledge of the main institutes of environmental law and sustainable development, through the analysis of the international and supranational documents that have marked its historical evolution;

- carry out a comparative analysis of the various environmental disciplines adopted by contemporary legal systems, through the study of the main European countries, as well as of some frontier experiences from other areas of the world;

- provide the basic notions of Italian environmental law, starting from the constitutional dimension and focusing on some particularly significant sector disciplines;

- to obtain an in-depth knowledge of the different legal profiles of sustainable development, in its environmental, economic and social dimensions, through an analysis that is not only theoretical, but based on the examination of some practical applications of sustainability in European and national policies;

- introduce the understanding of the 2030 Agenda and the European Green Deal and the related implementation tools, both at European and national level, including Next Generation EU and PNRR.

 

Expected learning outcomes:

At the end of the course the student shall:

- demonstrate an adequate knowledge of the institutes of environmental law, with particular reference to the general principles established at international and European level and then translated into practice in the various sectoral disciplines;

- achieve a full mastery of the concepts related to sustainability (environmental, economic and social), in order to be able to correctly analyze the institutions through which these concepts are put into practice.

- know how to recognize and analyze the various models of legal regulation of the environment adopted in the context of the systems analyzed, identifying the relative differences and similarities;

- know and correctly apply the legal language and technical terminology used in the field of environmental law;

- acquire an adequate understanding of the various legal instruments linked to the European Green Deal, in order to be able to critically analyze the ongoing reform processes at national and European level in the context of ecological transition.

TEACHING METHODS

The course includes 36 hours of lessons. The lessons will be mainly frontal, but may also include the textual analysis of normative and jurisprudential texts. The lessons will be held in Italian and will be integrated with slides. In addition, lectures, conferences and conventions on the subject may also be an integral part of the course, which in this case will be reported by the teacher during the course and via AulaWeb.

Attendance is not compulsory, but there will be a special program for attending students, which will be communicated in class.

SYLLABUS/CONTENT

The teaching program is divided into three parts:

a) in the first part the bases of environmental law and sustainability will be studied, through the analysis of the relative historical evolution and of the principles established at international and European level;

b) the second part will be dedicated to the study of sustainable development, through the study of some sectoral disciplines through which, at national and European level, this principle is put into practice.

c) in the third part the juridical regulation of the environment will be analyzed in a comparative perspective, through the examination of some institutes such as environmental rights and environmental justice.

Non-attending students shall study the following texts:

B.G. Mattarella, Il governo dello sviluppo sostenibile, Giappichelli, 2023, Parts I, II, III e IV.

Attending students will be given teaching materials in part substitutes for the texts indicated above.

EXAMS

EXAM DESCRIPTION

The final exam will take place orally.

For attending students, alternative ways of learning assessment will be indicated during the course.

ASSESSMENT METHODS

The exam will consist in passing an oral question aimed at ascertaining the knowledge of the topics covered in the course, the adequacy of the expository order, the mastery of the legal technical language.
