CODE 107040 ACADEMIC YEAR 2023/2024 CREDITS 6 cfu anno 2 AMMINISTRAZIONE E POLITICHE PUBBLICHE 8772 (LM-63) - GENOVA SCIENTIFIC DISCIPLINARY SECTOR IUS/21 TEACHING LOCATION GENOVA SEMESTER 2° Semester MODULES Questo insegnamento è un modulo di: NEW TECHNOLOGIES AND DIGITALIZATION IN COMPARATIVE AND EUROPEAN LAW TEACHING MATERIALS AULAWEB AIMS AND CONTENT LEARNING OUTCOMES The class critically analyzes the problems that, in the light of comparative experience, emerge from the digitization processes of public decision-making, in terms of transparency, fairness and non-discrimination. At the end of the course, the student will know the main problems related to digitization for the protection of individual rights and will be able to critically analyze the algorithm-based and data-intensive decision-making processes and to assess the results they achieve. AIMS AND LEARNING OUTCOMES The learning objectives outlined in the previous point are as follows. At the end of the course the student will - will be familiar with the main interpretations of the concept of discrimination and the essential features of anti-discrimination law - will also be familiar with the concepts of rule of law, due process and fairness and impartiality of the PA - will be able to recognise the main indicators for detecting treatment that does not comply with the principles of impartiality and fairness - will be able to identify the main risks posed by the processes of digitisation of Public Administration action, especially where these affect individual legal situations On this basis, at the end of the course the student will - Will have understood the concept of discrimination in its declinations: - Will be in possession of the conceptual tools necessary to identify and highlight the risks posed by digitalisation processes from the point of view of the proper performance of public administration decision-making processes - Will have the conceptual tools to handle the risks mentioned in the previous point. SYLLABUS/CONTENT The teaching programme consists of the following main points: - Digitisation processes and their impact on intersubjective relations - Algorithms, big data and artificial intelligence (introductory notions) - Public administration the principles guiding its functioning - Rule of law, due process and the activities of public administration - The principle of equality and its vertical declinations - The concept of state action - The notions of discrimination and anti-discrimination law - The adaptive nature of algorithms and the dimensions of discrimination TEACHERS AND EXAM BOARD EDMONDO MOSTACCI Ricevimento: Prof. Mostacci receives students by appointment to be agreed upon by e-mail at edmondo.mostacci@unige.it. The exam text consists of three parts: - A multiple-choice test of 10 questions - A second test, consisting of 5 True or False questions. - An open question, to be answered in an allotted space of approximately 350 words. ASSESSMENT METHODS The three parts of the written exam aim to test three different types of student abilities. The multiple-choice test is designed to test knowledge of the course's formative content; The True or False section consists of five short texts that present issues related to comparative law of economic , whose solution requires the student to use the acquired knowledge in order to analyze the proposed issue. The open-ended question aims to test the student's ability to critically analyze, from a theoretical point of view, a specific issue of economic law, illustrating its different facets.
