OVERVIEW

The course aims to provide all the basic notions indispensable for understanding the subject of private law, with particular reference to the area of the law of obligations and contracts.

The course also aims to provide students with the tools to correctly use legal language and fundamental legal concepts.

AIMS AND CONTENT

LEARNING OUTCOMES

At the end of the course the student will acquire sufficient knowledge to allow a critical analysis of the civil code discipline.

AIMS AND LEARNING OUTCOMES

Upon completion of the course, the student will be able to:

Understand and remember the main regulatory provisions governing the law of obligations and contracts;

Identify and critically analyze the main institutions of the law of obligations and contracts;

Understand the structure and operating mechanism of the private sector system, with particular reference to the obligation and the contract;

Understand and critically evaluate, with autonomy of judgment, some concrete problems regarding obligations and contracts;

Read and critically examine, with independent judgment, the texts of sentences, in particular those of the Court of Cassation;

Express yourself in appropriate legal technical language.

PREREQUISITES

The prerequisites set out in the study manifesto and the teaching regulations must be respected.

TEACHING METHODS

Frontal lectures

Vincenzo Roppo, Diritto privato. Linee essenziali, Turin, Giappichelli, seventh edition, 2022 (or possibly a later edition).

The scheduled chapters are:

1 to 7, 18 to 42 (for a total of approximately 450 pages).

The text of the Civil Code indicated is as follows: Codice civile per la didattica e lo studio, a cura di Roberto Pucella, II ed., Giappichelli, 2023 (or newer edition, if any).

The exam is written (10 open-ended questions).

ASSESSMENT METHODS

The exam aims to ascertain the actual knowledge of the subject by the students, who will then be asked, with respect to the various answers, to carry out a brief legal reasoning.
