CODE 67120 ACADEMIC YEAR 2026/2027 CREDITS 3 cfu anno 2 GIURISPRUDENZA 11864 (LMG/01 R) - IMPERIA SCIENTIFIC DISCIPLINARY SECTOR IUS/21 LANGUAGE Italian TEACHING LOCATION IMPERIA SEMESTER 2° Semester MODULES Questo insegnamento è un modulo di: PRIVATE AND PUBLIC COMPARATIVE LAW AIMS AND CONTENT AIMS AND LEARNING OUTCOMES The course develops a comparative study of the main models of constitutional justice, analyzing their origins, structure, functions, access procedures, decision-making techniques, and role in the protection of fundamental rights. The course aims to provide students with conceptual and methodological tools for understanding the differences between models of constitutional review, the role of Constitutional Courts in contemporary democratic legal systems, and the impact of constitutional justice on the form of the State, the form of government, and the protection of fundamental rights. Attendance at lectures and individual study will enable students to: acquire the specific terminology, also in order to examine and understand scientific literature in a foreign language; identify the models of constitutional justice and their historical evolution; acquire the essential knowledge-based tools for reading and understanding constitutional case law; critically assess the role of constitutional justice in contemporary legal systems; use knowledge of the theoretical elements to apply constitutional principles in the analysis of concrete cases. TEACHING METHODS L’insegnamento si sviluppa attraverso lezioni frontali, per un totale di 18 ore (pari a 3 CFU), nel corso delle quali verranno esposti analiticamente gli argomenti del programma. SYLLABUS/CONTENT The course addresses the following topics from a comparative perspective: The origin of constitutional justice; The classifications of systems of constitutional review; The circulation and hybridization of models; Access to constitutional justice, types of decisions, and other functions of constitutional courts; Constitutional justice, forms of State and government, and protection of rights. RECOMMENDED READING/BIBLIOGRAPHY The teaching materials required for exam preparation – including slides used by the professor during classes, legal materials, and the texts selected for further study – will be made available on the AulaWeb platform. The materials will be organized into two separate folders: one reserved for attending students, namely those who have attended at least 75% of the classes, and one intended for non-attending students. Any alternative textbooks for foreign students will be indicated by the professor at the beginning of the course. Additional texts and supplementary materials may be indicated during the course. Class schedule The timetable for this course is available here: Portale EasyAcademy EXAMS EXAM DESCRIPTION For both attending and non-attending students, the exam will be oral and will consist of a series of questions, approximately four. Students must register for the exam online within the prescribed deadlines. Failure to register will make it impossible to take the exam. The examination board is chaired by the professor responsible for the course. ASSESSMENT METHODS The oral exam is aimed at assessing students’ knowledge of the topics covered by the course. The assessment of the level of learning will result in a final grade expressed out of thirty. The grade will be awarded on the basis of the oral examination, which is intended to verify the student’s understanding of the course topics, the quality of presentation – in terms of clarity, precision, command of legal terminology, and organization of the discourse – as well as the student’s ability to critically analyze and personally re-elaborate the topics studied. The oral exam is designed to ascertain the effective achievement of the expected learning outcomes.
