OVERVIEW

The course aims to provide a knowledge and understanding of the main aspects of Roman legal experience, which, through its cultural tradition and practical applications, formed the foundation of continental European legal systems. This course examines the origins of the institutions associated with the modern notion of "commercial law."

The course aims to provide a knowledge and understanding of the main aspects of Roman legal experience, which, through its cultural tradition and practical applications, formed the basis of the legal systems of continental Europe.

AIMS AND LEARNING OUTCOMES

Upon completion of the course, students will be able to

- outline the origins and development of commercial law in ancient Rome throughout its various historical periods;

- understand the formation of this specific branch of law through Roman legal science, public laws, and imperial constitutions;

- illustrate, in their essential aspects, the negotiation and procedural frameworks developed to meet the needs of the economics of trade and commercial traffic.

PREREQUISITES

Normal education provided by secondary school.

TEACHING METHODS

The course consists of lectures and exercises on legal texts. The material published on Aulaweb includes a summary of the main sources of law and the topics covered in class.

Students with valid certifications for Specific Learning Disorders (SLD), disabilities or other educational needs and having complied with Unige procedures who need compensatory measures to prepare the exams or during the exams are invited to contact the teacher at the beginning of the course to agree on any teaching methods that, in accordance with the teaching objectives, take into account individual learning styles . SYLLABUS/CONTENT

 

Starting from the constitutional experiences of ancient Rome throughout the ages, the course will examine the formation of legal norms currently described as abstract and general. It will then follow the development of private law legislation in the two areas of ius civile and ius honorarium. In this context, the emergence of the main contractual forms and their corresponding legal regimes will be explored, paying particular attention to contracts pertaining to domestic and international trade.

EXAM DESCRIPTION

For both attending and non-attending students, the exam consists of an oral examination on the syllabus covered. The examination is primarily intended to assess the student's understanding of the historical relevance of the main principles of commercial law.

ASSESSMENT METHODS

The oral exam aims to assess the student's ability to navigate the theoretical concepts and concrete cases covered in class—or learned from reference texts for non-attending students—with regard to the relevant legal framework.

The exam will assess whether the student is able to:

- understand the general framework of the periods examined with reference to governing bodies and sources of law;

- identify and define legal concepts using appropriate language;

- correctly define and contextualize the individual legal institutions related to businesses;

- historically contextualize the legal provisions relating to commercial enterprises.
