OVERVIEW

The teaching is concerned with the private legal regulation of the most important and most common contracts in the tourism sector.

AIMS AND CONTENT

LEARNING OUTCOMES

The objective of the course is to provide students with a basic knowledge of private law, focusing mainly on contracts. This will enable them to subsequently analyse both tourist contracts regulated by law and those most common in economic and social practice, even if not regulated by law.

AIMS AND LEARNING OUTCOMES

The first objective of the teaching is to provide learners with knowledge of some of the essential concepts of private law, without the mastery of which it is not possible to approach the study of the private discipline of the tourism sector.

To this end, the following topics will be analyzed: sources of law, interpretation of the law, subjective legal situations, and contracts in general.

Having acquired the fundamentals of private law, the remaining part of the course will focus on the most economically relevant and widespread contracts in commercial practice.

Thus, we will focus on: contracts of navigation and transportation, hospitality contracts, organized tourism contracts, tourist leases, and timeshares.

Active class attendance and individual study will enable students to: 

- know the sources of private law and their relationships in the current national and supranational legal system;

- interpret normative documents;

- understand the structure and functioning of the main institutes of private law;

- appreciate the declinations that these institutions undergo within the tourism sector;

- express themselves correctly in technical-legal language.

TEACHING METHODS

Lectures and analysis of some judgments. Attending students who wish to do so will be able to expound on rulings in the classroom (more information will be provided during the first lectures).

SYLLABUS/CONTENT

The program is divided into two parts.

General part: the sources and interpretation of law, legal situations, obligations and contract.

Special part: private autonomy in tourism, tourist booking, navigation and transport contracts, hospitality contracts, tourist leases, organized tourism contracts, timeshares, protection of tourist rights.

RECOMMENDED READING/BIBLIOGRAPHY

The program is identical for attending and non-attending students:

• General part: lecture notes.
• Special part: Renato Santagata, Diritto del turismo (Tourism Law), sixth edition, Utet, 2025: Chapters 1 and 5; 7-15; 18-19 (for a total of approximately 200 pages).
• It is essential, especially for individual study in preparation for the exam, to use an up-to-date civil code. To this end, we recommend Codice civile, edited by R. Pucella, Giappichelli, latest edition, 2025 (forth.).

EXAMS

EXAM DESCRIPTION

The examination is conducted exclusively in written form. Students with specific learning disorders are invited to contact the professor at the beginning of the course in order to arrange appropriate examination arrangements.

There is no so-called appellate skipping: in case of a negative result, the exam can therefore also be taken in the immediately following session.

ASSESSMENT METHODS

The written test is designed to test knowledge and understanding of program topics, expository and argumentative skills.
