OVERVIEW

The Law of the Sea is a part of International Law that focuses on the regulation of the activities of States in their international relations concerning the various uses of different zones of the seas as defined by the 1982 United Nations Convention on the Law of the Sea (UNCLOS).

AIMS AND CONTENT

LEARNING OUTCOMES

The aim of the Course is to analyze the international rules of the law of the sea governing the different jurisdictional maritime zones, the rights of coastal and flag States, the exploitation of living and non-living resources, the protection of the marine environment, the maritime safety and security.

AIMS AND LEARNING OUTCOMES

At the end of the Course, students should have to acquire in-depth knowledge and understanding of the fundamental principles of the Law of the Sea and should be able to elaborate their skills. In particular, they should have to understand legal problems and come to concrete conclusions. In addition, students should be able to communicate in a clear way their knowledge and results. Finally, they should have to develop adequate learning skills in order to implement the study of the subject by themselves.

TEACHING METHODS

The Course is based on traditional lessons.

Interactive student participation is encouraged.

SYLLABUS/CONTENT

  • Delimitation and legal status of the different maritime zones (internal waters, territorial sea, contiguous zone, exclusive economic zone, continental shelf, international seabed area, high seas)
  • Protection of the marine environment (prevention, reduction and control of pollution from ships; shipowners’ liability for oil pollution damage resulting from maritime casualties involving oil-carrying ships and ships carrying hazardous and noxious substances)
  • International and European law on maritime safety and security

ASSESSMENT METHODS

The exam aims to verify students’ learning skills, in-depth knowledge and understanding of the fundamental principles of the Law of the Sea, understanding of legal problems, abilities to come to concrete solutions and communication skills.
