AIMS AND CONTENT LEARNING OUTCOMES The course is focused on an institutional study of the constitutional and administrative organization of the state, both of the central apparatus and the system of the territorial autonomies and the other public bodies. A Particular attention is showed for the sources system, the dynamics of the powers, the jurisdiction and the individuals and collective rights and duties. AIMS AND LEARNING OUTCOMES The main goal of Public Law is to provide a thorough knowledge of Italian Constitutional Law and fundamental principles of Administrative Law, together with the main aspects of Italian Welfare State referred to health and social care. The teaching provides the basic skills for the study of the other legal subjects taught in the three-year degree Course in Social Sciences. It is also linked to non-legal teachings of the Course in Social Science (see especially those taught in the first and second year). At the end of the teaching students will be able: to understand and comment on Italian Constitution; to recognize the Italian sources of law, also seen from the perspective of their interaction with International and European Union sources of law; to understand the relations among constitutional powers of the State; to understand the relationships among jurisdictions; to know the different levels of local and regional government of the Italian Republic; to know the basic functioning of the Italian Public Administration; to know the Fundamental Rights protection systems; to know the core elements of Italian Welfare State referred to health and social care. TEACHING METHODS 36 hours of lectures given by the professor of the teaching. Students are kindly recommended to register on Aulaweb. SYLLABUS/CONTENT Public law includes the study of the following topics: The concepts of Law and State; Constitution and sources of law; Forms of State and Government; Relations among State, European Union and International Legal System; Rights and duties of citizens and people (in particular the rights of healthcare and social assistance); Italian Republic’s Legal System: constitutional bodies and their functions; Ordinary and special judges; Regions and Local Authorities; Constitutional Court and Judicial review; Principles, acts and procedure of Public Administration. Students who will pass the written exam can ask to take an integrative oral exam (with which they will improve or worsen the mark achieved in the written exam): it will take place on the day and at the time indicated on the day of the written exam. If the student does not wish to take the supplementary oral exam, the exam is concluded with the written exam. A list of possible exam questions will be made available on Aulaweb at the end of the teaching. ASSESSMENT METHODS The Examining Board is made up by the Professor of the teaching together with Public Law scholars approved by the Department Council. The Examining Board will evaluate the consistency and completeness of the answers, the correct use of legal language and the ability to make connections among different topics of Public Law. Frequency and the active participation during the lessons will also be evaluated.
