OVERVIEW

Labour law is a fundamental discipline of a specialist nature. The course aims to provide the knowledge necessary for understanding the functioning of the labour market by studying the rules that govern it. For the learning of labour law students must have already acquired basic legal concepts (Private Law, Public Law).

AIMS AND CONTENT

LEARNING OUTCOMES

The course aims to provide the basic knowledge of labor law and the right of individual labor relations in the private sector and at the same time to provide the interpretative tools necessary for understanding the dynamics that affect our workplace in our country, with a A methodological approach that allows the subsequent self-updating of a constantly evolving subject.

AIMS AND LEARNING OUTCOMES

The course has as its main objectives: to provide the basic and analytical tools essential for knowledge of the industrial relations system as welle as the set of rules governing the labour market. Particular attention is devoted to the study of employments contracts, social security and active and passive labour market policies.

TEACHING METHODS

Lectures, supplemented by analysis of case law (leading cases). A  mid-term test will be reserved for students attending the course.

SYLLABUS/CONTENT

Course of Labour Law (9 CFU)

Part I: Sources of labor law, with special regard to collective bargaining

Part II: Subordination, autonomy, typical and atypical employment contracts

Part III: The Discipline of the employment relationship. Obligations of the employee. Powers of the employer. Working time and part time. Remuneration. Suspension of the employment relationship. Termination of the employment relationship and disciplines of dismissal and collective redundancies.

Part. IV. Fundamental workers’ rights: equality, freedom,  dignity.

Part V: Guarantees for workers' rights

The course of Labour Law (6 CFU) is available to students who want to include it among the teachings of their choice (within the 12 CFU available for other training activities) in order to enrich their education with the acquisition of the basics of the labour market legal rules.

Oral examination

ASSESSMENT METHODS

Oral examination, consisting in the formulation of some questions that, starting from the general notions (for example: the fixed term contract; the dismissal; the notion of employee), allows to verify, by further questions, whether the student has deepened the study of the subject (current discipline, controversial issues).

FURTHER INFORMATION

Prerequisites: In order to take the labour law exam, it is necessary to have passed Institutions of private law and Institutions of public law.

Continuity with the "Lauree Magistrali" in the Department: Having taken the labour law exam is useful, even if not indispensable, to take the Consulenza del lavoro exam (AFC Laurea magistrale Administration, Finance and Control) and the Dirirtto delle relazioni industriali exam (Laurea magistrale in Management).

Expected learning outcomes: Knowledge and understanding of the main institutes of labour law; Ability to apply the concepts learned; Ability to independently tackle the case solution; Ability to express legal concepts using an appropriate technical language; Ability to learn not only the individual notions, but also the logic of labour law in order to be able to deal with the solution of new cases.
