CODE 102010 ACADEMIC YEAR 2020/2021 CREDITS 9 cfu anno 2 ECONOMIA E MANAGEMENT MARITTIMO E PORTUALE 8708 (LM-77) - GENOVA SCIENTIFIC DISCIPLINARY SECTOR IUS/06 LANGUAGE English TEACHING LOCATION GENOVA SEMESTER 1° Semester TEACHING MATERIALS AULAWEB OVERVIEW The course introduces students to a deeper knowledge of the most significative maritime contracts as well as of the most important "marine "coverages (hull and machinery coverages, goods coverages, and shiponwers' and carriers' liabilities) AIMS AND CONTENT LEARNING OUTCOMES The aim of the first part of the course is to introduce the students to the knowledge of the maritime contracts as regulated by the most important international forms - which are at present available in the maritime market - concerning shipbuilding, ship repairs and ships sales, ship management, bareboat charters, time and voyage charters, contracts of affreightment and service contracts, carriage of goods by sea, towage and salvage contracts. In the second part, the aim of the course is to introduce the students to the knowledge of all the marine insurance coverages concerning hull and machineries as well as goods to be carried and liabilities of shipowners and maritime and multimodal carriers, as provided for both by the Italian legal system and by the international market, mainly based on English and Scandinavian rules and principles AIMS AND LEARNING OUTCOMES The aim of the course is to give the students an adequate knowledge and familiarity with the most important maritime contracts as well as with the marine insurance contracts described in the course program TEACHING METHODS The course is based on traditional lessons with direct study of the most important maritime forms and insurance coverages and discussion on the items. Also seminars and/or meetings aimed at the study of specific topics and also testimonial from maritime operators can be organized. SYLLABUS/CONTENT Part 1 - Maritime Contracts Maritime forms and their general characterics The property contracts: Shipbuiding Contracts and Ship Sale Contracts The management contracts: Shipmanagement Contracts and Bare Boat Charters Charterparties: Time Charter, Voyage Charter and Contract of Affreightmet Tha carriage of goods by sea documents: Bill of Lading and Seawaybill The ship assistance contracts: Towage and Salvage Contracts Further contractual forms (ships' repairs, security, bunker sale, containers' use, etc.) Part 2 -- Marine insurance Italian legal rules (code of navigation and civil code) and Marine Insurance Act provisions. Marine insurance operators. Perils and risks in the navigation. The marine insurance contracts system (policies and clauses) and the marine insurance markets (English and Scandinavian markets). Hull and Machinery coverages, builders' risks' coverages - war risks - loss of hire coverages (according to the italian insurance system as well as the Institute of London Underwriters Clauses and the Nordic Marine Insurance Plan provisions). Coverages of goods in transit accorrding to italian insurance system and according to Institute Cargo Clauses.
