AIMS AND CONTENT LEARNING OUTCOMES The Course analyzes the Italian regulation of the contract of passengers by sea in comparison with other modes of transport, focusing on passenger rights. The Course also deals with the main contracts in the tourism sector with particular attention to the cruise contract and the tour contract. AIMS AND LEARNING OUTCOMES The course is devoted to examining the main private legal aspects related to contract of carriage of passenger by sea. National, European, and International regulations on this contract will be analysed, focusing on the obstacles to contract performance and the carrier liability regimes. A comparative analysis of other modes of transport will be carried out. Furthermore, passenger rights and protection will be treated. Additionally, travel and tourism contracts will be studied, considering cruise and travel package contracts. Moreover, yachting contracts, hospitality contracts and tourism rental contract, focusing on their regulation, legal classification, and respective main professional figures. Legal issues having an important impact from an economic and social point of view will be dealt with. All the studies will be undertaken in a critical structural approach methodology by treating doctrine, jurisprudence, and maritime practice. Successful students will be able to orientate themselves through the subject-matters considered during the course and therefore be able to tackle the relevant legal issues by taking into consideration the most valid solutions. PREREQUISITES No prerequisites. TEACHING METHODS The course consists of 72 hours of frontal lectures given also by digital devices and internet. Within the course seminars and/or webinars will take place also in English to focus on programme’s subject-matters. Seminars and/or webinars will be given by invited experts and representatives of the main private and public bodies, associations, authorities, institutions, and organizations which are involved in passenger maritime transport and tourism sector at National, European, and International level. Seminars/Webinars’ Calendar will be provided to students. In addition, documents (clauses, contract models, general conditions of contracts, measures, and judgements) related to the programme topics will be provided to course students and analysed. For closer examination of the issues examined, publications in the University’s libraries, will be made available on request to students. ASSESSMENT METHODS Written Exam Written test will consist of three questions related to topics of the course programme. Oral Exam Oral exam will consist of a discussion on the topics that the student dealt with in the written test.
