OVERVIEW

The teaching unit introduces students to the main institutions of Transportation Law through the examination of the relevant legislation.

 

AIMS AND CONTENT

LEARNING OUTCOMES

The Course aims at providing students with the basic knowledge of international, UE and national legislation on the ownership and management of transport infrastructure (ports, airports, roads and railways), on the access to the market and the performance of maritime, air, road and rail transport services and on the main contracts in the transport sector (building and sale contracts of the means of transport and their use).

AIMS AND LEARNING OUTCOMES

At the end of the teaching unit, the student will be able to:
- Understand and explain the main institutions of Transportation Law (Knowledge and understanding - Dublin Descriptor 1) through the analysis of international, EU, and national legislation.
- Apply the acquired legal terminology (Applying knowledge and understanding - Dublin Descriptor 2) in drafting and discussing practical cases related to the transport sector.
- Critically analyse legal texts and case law (Making judgements - Dublin Descriptor 3) to draw well-founded conclusions in simulated or real contexts.
- Communicate the acquired knowledge effectively (Communication skills - Dublin Descriptor 4) using appropriate legal language in oral or written presentations.

 

PREREQUISITES

For a proper understanding of the subject, foundational knowledge of Private and Public Law is necessary, with particular reference to: sources of law, administrative acts, public goods and the concession regime, natural and legal persons, obligations, contracts, contractual and non-contractual liability.

TEACHING METHODS

The course consists of 72 hours of frontal lectures in Italian.
Attendance is not mandatory, but it is strongly recommended.

Students with certified disabilities, specific learning disorders (SLD), or special educational needs are required to contact both the instructor and the Department of Economics’ Disability Coordinator, prof.ssa Serena Scotto, at the beginning of the course. This is to agree on appropriate teaching and examination arrangements that, while respecting the learning objectives of the course, take into account individual learning needs and allow for the use of any necessary compensatory tools.

- Sources of Transport Law
- Bodies and associations in the transport sector
- Infrastructure: ports, airports, and linear infrastructures
- Transport services: port operations and technical-nautical services; airport assistance services, rail services
- Access to the maritime, air, rail, and road transport markets
- Contracts: construction and sale of vehicles, contracts of carriage of passengers and goods, multimodal transport, charter, travel, logistics

- Sources of Transport Law
- Ports and port services
- Access to the maritime transport market
- Contracts for acquiring the availability of the vehicle
- Charter contracts
- Contracts of carriage of passengers and goods
- Complex contracts including transport services (logistics and travel contracts)

Attending students may prepare for the exam using their lecture notes, with the slides serving as summary outlines. It is recommended that they compare their notes with the course materials provided by the instructor.
Non-attending students may prepare for the exam using the instructor’s materials, with the slides serving as summary outlines.
All students, whether attending or not, are strongly encouraged to assess their level of preparation before the exam by completing the practice quizzes.

EXAMS

EXAM DESCRIPTION

The final written exam consists of at least three open-ended questions in Italian and it assesses students’ knowledge of the entire program.
Attending students can take the exam by passing two intermediate written tests that will take place respectively towards the middle and at the end of the teaching unit.

ASSESSMENT METHODS

The exam aims to assess:
- knowledge and understanding of the main institutions of Transportation Law through open-ended questions;
- the ability to apply legal terminology and critically analyse legal texts and practical cases;
- clarity of exposition and correct use of legal language.
Assessment criteria include: accuracy of answers, analytical skills, appropriate use of terminology, and clarity of exposition.
