Constitutional, international and supranational sources. Italian Criminal Law relevant for the social service degree. AIMS AND LEARNING OUTCOMES Specifically, Module 2 aims to provide students with in-depth knowledge of the juvenile criminal process, with particular emphasis on the areas in which the role and activities of the social worker in the criminal process emerge, highlighting the connections with the ordinary criminal process. Individual study, attendance, and participation in the proposed training activities will enable students to: • Understand and remember the legal provisions governing criminal procedural law, especially juvenile criminal law; • Understand the structure and application mechanisms of juvenile criminal procedural law and be aware of their differences; • Identify the various procedural phases in terms of both their development and content; understand, interpret, and apply the relevant regulatory framework (Presidential Decree 448/88); • Distinguish the various procedural institutions, understand their rationale, and their respective "interconnections" with criminal law; • Identify, understand, and distinguish the main institutions of ordinary criminal proceedings; • Understand and contextualize any legislative interventions related to Presidential Decree 448/88 and complementary criminal procedural legislation; • Read and critically examine, with independent judgment, scholarly articles on juvenile criminal procedural law, rulings by lower courts, Supreme Courts, and the Constitutional Court, as well as European judgments relating to criminal procedural issues; • Acquire appropriate technical legal language and use it to express yourself correctly. TEACHING METHODS The course consists of lectures, for a total of 36 hours (equivalent to 6 credits). These lectures will present and analyze, in particular, the principles of juvenile criminal procedure law, the subjects of juvenile proceedings, forms of restriction of personal liberty, forms of diversion, and security measures, always in connection with ordinary criminal procedural law. Some lectures will illustrate practical cases and procedural measures of particular relevance, providing opportunities for further study. Magistrates and lawyers may occasionally be invited to give lectures on topics of particular interest and relevance, also to allow students to gain a greater understanding of the practical aspects of the subject. Lectures are held in the second semester and are in-person. SYLLABUS/CONTENT Study of criminal procedural law, with particular reference to juvenile proceedings and with the necessary references both to ordinary criminal proceedings, referred to by virtue of the principle of subsidiarity (Article 1 of Presidential Decree 448/88), and to penitentiary law, always with specific attention to the role of the Juvenile Social Services. ASSESSMENT METHODS The oral exam aims to assess the student's knowledge and acquisition of theoretical concepts related to the topics covered in the program. General theoretical questions will be used to assess whether the student is able to: • identify and define legal concepts using appropriate technical language; • identify, distinguish, know, understand, interpret, and apply, with a critical mind and independent judgment, both the regulatory provisions that comprise juvenile criminal procedural law and the main institutions of ordinary criminal procedural law and penitentiary law, knowledge of which is essential for a comprehensive understanding of the subject matter. • define the role of Social Services in the juvenile criminal process and the sentence execution phase.
