OVERVIEW

The subject concerns Private Law, in all its main aspects and problems, with particular attention to the arrangement of the discipline provided by the Civil Code in force in the integrated framework of sources.

Private Law constitutes the basic conceptual framework of any discourse that has legal norms as its object, so that its study and learning represent a fundamental and unrepeatable moment in the training of anyone who studies, at any level, law.

With this awareness, the Course addresses the major themes of Italian Private Law through the examination of its institutions, moving from the legal provision that regulate them, retracing their continuous evolution, with particular attention to the historical and social interrelations that must distinguish the teaching of Private Law for those who study Political Science, and arranging them within an order that is as rational and coherent as possible.
 

AIMS AND CONTENT

LEARNING OUTCOMES

The course aims to provide knowledge of the fundamental institutions of private law. In addition to the fundamental legal notions, the subject of obligations and contracts, property rights and liability are the subject of particular study.

The course aims to provide students with basic notions of private law, with particular regard to the following topics:

- Private law in the legal system

- The sources of private law

- Legal situations and their circolation 

- Property and assets

- The subjects of law

- Rights on things 

- Obligations

- The contract in general

- Typical and atypical contracts

- Tort Law

- Market regulation

Individual study and active attendance of lectures and training activities offered will allow students to:

- Understand and remember the main regulatory provisions governing private law;

- Identify, understand, and apply the rules of private law;

- Understand the structure and functioning mechanisms of private law, thus becoming aware and critical of the problems of application;

- Read and critically examine legislative texts, doctrinal contributions, jurisprudential cases;

- Express themselves in an appropriate technical and legal language.

TEACHING METHODS

The Course is divided into 54 hours of frontal lessons (equal to 9 CFU).

The lessons will be held in person by the teacher and simultaneously online, for those who, for work reasons communicated to the teacher before the start of the lessons, cannot attend in person.

At the end of each lesson, questions or difficulties encountered in participating in the lesson or in individual study may be examined.

All communications between the teacher and the students will take place on Aulaweb, which should be frequently consulted. 
 

 

SYLLABUS/CONTENT

The Course covers all private law matters, with the only exception of Family Law and Successions. In particular, the following topics will be addressed:

- Private law in the legal system

- Rights

- Subjects

- The rights on things

- Obligations

- The contract in general

- Contracts

- Tort law and the other sources of obligations

- Market regulation


The teacher reserves the right to concentrate the in-depth study of certain topics in class, leaving others to individual preparation.
 

RECOMMENDED READING/BIBLIOGRAPHY

The following textbook is recommended:

V. Roppo, Diritto privato. Linee essenziali, Giappichelli, latest available edition.

For attending students, the textbook should be studied in the parts corresponding to the topics covered in class, together with the notes, complete and ordered, and any additional materials reported and indicated or made available on Aulaweb. For non-attending students, thetextbook should be studied in its entirety in chapters 1-42 (the chapters refer to the VIII edition, Turin, 2024).

The use and reasoned consultation of the following commented Code is recommended:

Codice civile. Per la didattica e l'insegnamento, a cura di R. Pucella, Turin, Giappichelli, 2022 (II edition).

Other editions of the Civil Code and complementary laws are equally suitable. Additional material may be indicated and/or made available on Aulaweb.

EXAMS

EXAM DESCRIPTION

The exam is oral.

ASSESSMENT METHODS

The oral exam aims to verify the student's actual knowledge and acquisition of basic theoretical notions, as well as, and in particular, his ability to express himself with expressive propriety, mastering the technical legal language.

The purpose of the exam is not only to ascertain and evaluate the (although indispensable) possession of notions but also the ability to address problems and reason systematically, knowing rules and qualifying facts.
