OVERVIEW

The Course introduces students to the knowledge of International, European and Italian legislation regulating the access to transport services, the related infrastructures and the main contracts in the transport sector with reference to their implications in the economic activities.

AIMS AND CONTENT

LEARNING OUTCOMES

The Course aims at providing students with a basic knowledge of Italian, European Union and International Legislations with regard to the main subjects of transport law (ports, airports and linear infrastructures, access to transport services and related infrastructures, transport contracts).

 

AIMS AND LEARNING OUTCOMES

At the end of the Course, students should have to acquire knowledge and understanding of the basic principles of Transport Law and should be able to elaborate their knowledge and understanding. In particular, they should be able to read critically the normative texts and draw their conclusions. In addition, having acquired a correct juridical language, students should be able to communicate their knowledge.

PREREQUISITES

Main topics of Private Law and Public Law. In particular, students need to know about: sources of law, administrative acts, public property and concession regime, natural and legal persons, obligations, contracts, contractual and tort liability.

TEACHING METHODS

The course consists of 72 hours of frontal lessons.
Class attendance is recommended.

- Sources of Transport Law
- Transport infrastructure (ports, airports, rail and road infrastructures)
- Transport services (port operations and technical-nautical services; ground handling services, rail services)
- Maritime, air, rail and road international and national transport regulations
- Building and sale contracts of vehicles, contracts of carriage of passengers and of goods, charterparties, multimodal transport contract, logistics services contract

Slides and lecture notes by the teacher made available to attending students in Aulaweb.
Recommended reading for all students: M. Casanova - M. Brignardello, Corso breve di diritto dei trasporti, Giuffrè, ed. II, 2020.
Otherwise, students can prepare the exam on any up-to-date university textbook that analysis all of the topics listed in the program.

EXAMS

EXAM DESCRIPTION

The written exam consists of at least three open-ended questions on the topics covered by the program of the Course.
Attending students can take the exam by passing two intermediate written tests that will take place respectively towards the middle and at the end.

ASSESSMENT METHODS

The exam aims to verify students’ learning skills, knowledge and understanding of the basic principles of Transport Law, critical reading of normative texts, ability to draw their own conclusions and to support their argumentation in a correct juridical language.
