The course tackles the study of the general part of criminal law, through the analysis of the main principles of guarantee, the notion of crime and the structure of the criminal sanctions, focusing in particular on fundamentals of economic and labor criminal law. The course is essential for all students who intend to work within companies or public administration in the future
The course aims to provide students with a firm preparation with reference to the general part of criminal law, with particular regard to institutions and issues involved by the organization of companies and the activities of public administration.
Through individual study and partecipation in lessons the student will be able to:
- Understand and remember the rules of criminal law and the structure of the sanctioning system;
- Understand the structure and the application of criminal dispositions and be aware of their diversifications;
- Identify the different components of criminal offences;
- Distinguish the different institutions of the general part of criminal law;
- Identify, understand and distinguish the different components of the sanctioning system;
- Know and remember the fundamental of economic and labor criminal law;
- Appreciate the importance of the institutions of criminal law in relation to the problems posed by companies management;
- Read and critically examine, scientific papers and judgments related to criminal law;
- Acquire and use an appropriate legal technical language
The course consists of lectures, for a total of 54 hours (equal to 9 CFU).
In the event of health emergency, lessons will take place according to the indicastions of the University of Genoa (also by Teams platform).
Texts of sentences, legislative reform and scientific papers will be published on Aulaweb.
- Fundamental principles of criminal law;
- Structure of offence: actus reus, mens rea, justifications;
- Actus reus: analysis of action, omission, chain of causation;
- Singles justifications: legal order, necessity, self defence, exercise of right, consent by rightholder;
- Mens rea: intention, recklessness, negligence;
- Shapes of crime: attempt, concurrent offences, circumstances, participation;
- Criminal sentences and preventive sanctions
- Fundamentals of economy and labor criminal law

The exam consist in an oral examination, with at least three questions about different topics, in order to verify to the different parts of the program.
The oral exam aims to verify the student's knowledge in relation to the topics of the program.
Through the questions, it will be verified whether the student is able to:
- remember, understand and apply the institutions of the general part of criminal law;
- understand, interpret and apply both the regulatory provisions to the general part of criminal law, as well as the texts of judgements;
- use an appropriate technical language.
