AIMS AND CONTENT

AIMS AND LEARNING OUTCOMES

The main purpose of the course is to ensure - also through active participation in the proposed training activities (lectures and exercises) - that the student assimilates theoretical knowledge of public law and general administrative law necessary for the study of urban planning law, construction law and public works law.

At the end of the course, the student will be able to understand the structure of the sources of Italian law, find legal material, illustrate the elements of an administrative provision, distinguish the main aspects of the administrative procedure, describe the central institutions of urban planning law, distinguish titles and building regimes, describe the procedure concerning public works

TEACHING METHODS

The teaching consists of a total of 40 hours: they will be divided into lectures held by the teacher and in one or more exercises.

The lectures will concern the topics indicated in the program, together with the examination of the legislation and certain judicial measures.

All documents viewed in class will be made available to learners on the AulaWeb page dedicated to the course.

The exercise - which is optional - will take place in the manner indicated in class and published on the AulaWeb page dedicated to the course. The positive outcome of the exercise will contribute to the final evaluation

SYLLABUS/CONTENT

In the part dedicated to public and administrative law, the following will be the subject of particular study: the system of sources of Italian law and the criteria for resolving antinomies; the division of legislative powers and administrative powers; the notion of deed and administrative provision; the fundamental features of the state discipline of the administrative procedure; the ability to find legal provisions, judicial measures and doctrinal contributions in the most widespread legal databases.

With regard to urban planning law, the course aims to retrace the main steps that led to the current legislation. Specific attention will be paid: to the constitutional regulation of private property and urban planning; to its relations with related disciplines (in particular, in the field of expropriation for public utility and cultural and landscape assets), as well as to planning in urban planning law with references to the regional one.

With regard to building legislation, the course aims to provide a synthetic classification of building titles since the promulgation of the urban planning law, in order to devote greater attention to the regulation of building regimes in the current consolidated text (Presidential Decree 380/2001), including including building permits, simplification and liberalization tools and sanctioning tools.

The part dedicated to the legislation of public works will examine the institutes related to the planning, design and construction of public works.

Giuffrida, Lineamenti di diritto amministrativo, Giappichelli, Torino, 2018, limited to the parts of the book indicated in Aulaweb. A new edition of the volume is expected to be published shortly

EXAMS

EXAM DESCRIPTION

Written test, consisting of three questions: one relating to administrative law / public law as far as the subject is concerned, one relating to urban planning / construction, one relating to public works.

The exam can be held orally in the case of a limited number of members and in the event of it being impossible to carry out the written tests in person.

ASSESSMENT METHODS

Timely information on the examination procedures will be provided in class.

The written exam will focus on the topics covered by the program as discussed in class and integrated in the light of the bibliography indicated.

The exam will ascertain the correctness of presentation, the use of the basic lexicon of legal sciences, as well as the ability to describe and contextualize the institutions studied.
