OVERVIEW

The European Union is a new kind of legal system in the field of international law. Both States, which chose to jointly exercise part of their sovereignty, and European citizens and institutions are part of the legal order of the European Union. Through this teaching, students will acquire the notions instrumental to understand the origin and the functioning of the EU as well as to critically assess its evolution.

At the end of the course, students will acquire the methodological tools and general competences related to the institutional framework of the European Union and the main policies of the Union, will be able to understand and analyse current legal issues of European Union law, and will be able to independently develop possible solutions to open questions

AIMS AND LEARNING OUTCOMES

The teaching is divided into two parts, the first one provides the students with 6CFU, the second adds 3 CFU:

  1. the first part deals with the legal and institutional system and, therefore, analyses the sources of law, the functioning of the institutions and the judicial protection (36 hours);
  2. the second part deals with the main EU policies and actions: fundamental rights, European Citizenship, the fundamental freedoms of movement for goods, persons, services, and capital; the area of freedom, security and justice (18 hours).

At the end of the teaching, the student will be able to:

  • understand the function of the European Union;
  • understand and critically analyze current integration issues;
  • engage in research activities on the sources of the EU law as well as on the case-law of the EU Court of Justice;
  • express his views on matters related to the EU with a proper language.

 

PREREQUISITES

The understanding of Italian law and its ways of transposing the EU law, as well as the basic knowledge on actors and sources of international law, is essential (some information will be given in the introductory lectures).

TEACHING METHODS

36 hours of classes are foreseen for the first part (6CFU), amounting to 18 frontal lectures of two hours each , and 18  hours for the second part (3 CFU),  all delivered by the teacher (Mraia Elena De Maestri) with the involvement of the students in presenting and discussing the fundamental cases of characterizing the European integration process.

Classes will follow the order of the topics as pointed out in the program and highlighted in aulaweb.

For the students attending of the lectures, teaching materials (such as the main sources of reference, texts of decisions and slides) aimed at integrating the contents of the recommended bibliography as well as at helping the students will be available on the aula web page of the teaching.

SYLLABUS/CONTENT

The teaching follows the syllabus proposed by the recommended bibliography (see infra).

The content of the first part of the course, devoted to the EU legal order, cover the following topics:

  • introduction on the European Union and on the European integration process;
  • the EU legal order (institutions, sources of law, decisional process and judicial system).

The content of the second part, devoted to the main EU policies and actions, covers the following topics:

  • fundamental rights
  • EU Citizenship
  • the fundamental freedoms of movement of goods, persons, services and capital;
  • the space of freedom, security and justice;

RECOMMENDED READING/BIBLIOGRAPHY

Students attending lectures will have to download materials and PPP slides from aulaweb. otes taken during lectres and the abovementioned materials can be sufficient for the preparation of the exam. However, in order to deepen their knowledge and improve their language, the manual to be studied is  ADAM R., TIZZANO A., Lineamenti di diritto dell'Unione europea, 2022, Quinta edizione, Giappichelli.

For students not attending lectures (or attending less tha 2/3 of the lectures) the manual to be studied is  ADAM R., TIZZANO A., Lineamenti di diritto dell'Unione europea, 2022, Quinta edizione, Giappichelli, the programem includes the whole book  (p. 1 - 465).

EXAMS

EXAM DESCRIPTION

The exam is oral and usually three questions are made to the student.

The students attending at least 2/3 of the classes are allowed to take a written tests (composed by 30 multiple choice questions and one  open answer), on the topics of the syllabus.

The students succeeding both tests do not have to take the oral exam. 

It is possible not to accept the vote of  the written test and take the oral exam.

ASSESSMENT METHODS

The exam’s aim is to verify whether students have acknowledged the program. By virtue of questions of theoretical general character as well as of the propsal of problems of a more practical nature, it will be assessed whether the student is able:

  • To find out and define the main notions of EU law;
  • To make use of a technical language in answering to the open question;
  • To find out and to apply the rules governing the internal market of the EU;
  • to know the main rules governing the functioning of EU instititions;
  • To know the scope of EU acts;
  • To know the instruments for the judicial protection in the EU
