The course is essential for all students who intend to work within companies or public administration in the future. AIMS AND CONTENT LEARNING OUTCOMES The course aims to provide students with a firm preparation with reference to the general part of criminal law, with particular regard to institutions and issues involved by the organization of companies and the activities of public administration. AIMS AND LEARNING OUTCOMES Through individual study and partecipation in lessons the student will be able to: - Understand and remember the rules of criminal law and the structure of the sanctioning system; - Understand the structure and the application of criminal dispositions and be aware of their diversifications; - Identify the different components of criminal offences; - Distinguish the different institutions of the general part of criminal law; - Identify, understand and distinguish the different components of the sanctioning system; - Know and distinguish trade fraud offences and crimes against public administration ; - Appreciate the importance of the institutions of criminal law in relation to the problems posed by companies management; - Read and critically examine, scientific papers and judgments related to criminal law; - Acquire and use an appropriate legal technical language - Communicate effectively in written and oral form and adapt one's communication to the context of a public or private company - Solve concrete cases (transversal competence that allows attending students to obtain, when they pass exam, the Open badge "soft skills: alfabetical basic 1-A") - Acquire knowledge and skills useful for the profession of corporate and public administration legal/administrative advisor, in accordance with objective n. 4 "Quality education" of the 2030 Agenda PREREQUISITES Having passed exams of Constitutional Law and Private Law TEACHING METHODS The unit is divided into a first predominant part of lectures, where general and special part of criminal law are explained, and a second part where students are invited to deal with concrete cases (crimes committed inside companies or public bodies), to analyse and suggest how they would manage and solve them. The course includes a total of 54 hours and 9 CFU. Texts of sentences, legislative reform and scientific papers will be published on Aulaweb. SYLLABUS/CONTENT - Fundamental principles of criminal law; - Structure of offence: actus reus, mens rea, justifications; - Actus reus: analysis of action, omission, chain of causation; - Singles justifications: legal order, necessity, self defence, exercise of right, consent by rightholder; - Mens rea: intention, recklessness, negligence; - Shapes of crime: attempt, concurrent offences, circumstances, participation; - Criminal sentences and preventive sanctions - Trade frauds and offences against public administration RECOMMENDED READING/BIBLIOGRAPHY Texts for attendant students: Lectures notes and in order of lectures objects: C.F. ASSESSMENT METHODS The oral exam aims to verify the student's knowledge in relation to the topics of the program.
