AIMS AND CONTENT

LEARNING OUTCOMES

Criminal law and procedure: Criminal Law System. Constitutional, international and supranational sources. Italian Criminal Law relevant for the social service degree.

AIMS AND LEARNING OUTCOMES

In particular, the teaching of module 1 aims to provide students with extensive notions and in-depth case law in the field of criminal law, with particular regard to the so-called vulnerable groups and the areas in which the role and activity of the Social Worker emerges.
Individual study, attendance and participation in the proposed training activities will enable the student to
- Understand and remember the regulatory provisions governing criminal law and the structure of the penalty system;
- Understand the structure and enforcement mechanisms of criminal law and be aware of their diversifications;
- Identify the different components of the criminal systematics as to their development and content; understandinterpret and apply the relevant regulatory framework;
- Distinguish between the different institutions of the general part, understand their raison d'être;
- Identify, understand and distinguish the different components of the penalty system;
- Understand and contextualise any legislative reform relating to the criminal code or complementary criminal legislation;
- Read and critically examine, with independent judgement, scientific articles in the field of criminal law, texts of judgments of the Courts of merit, legitimacy and the Constitutional Court and of European judgments relating to criminal matters;
- Acquire appropriate technical legal language and use it to express oneself correctly; 

- Acquire knowledge and skills useful in the social work profession, in accordance with Goal No. 4 'Quality Education' of Agenda 2030.

TEACHING METHODS

Unit mod. 1 consists of lectures, for a total of 36 hours (equal to 6 CFU), during which the guarantee principles of criminal law and the components of the systematics of crime and the system of sanctions, as well as the special part of criminal law, will be presented and analysed, with a parallel discussion of the most relevant case law orientations on the topics covered by the programme.
Periodically, texts of particularly relevant judgments and any regulatory reform on which to initiate specific in-depth studies and a collective discussion will be published on Aulaweb.
Occasionally, scholars, magistrates and lawyers may be invited to lecture on topics of particular interest and topicality, also in order to enable students to acquire a greater awareness of the concrete dimension of the subject.
Lessons are held in the first semester in presence.

Study of substantive criminal law (general part) with particular reference to juvenile criminal law and some areas of special legislation, such as the protection of vulnerable persons,  sexual offences, social workers criminal liability

The examination takes place in oral form and is developed by requesting an in-depth check of a variety of topics in order to extend the examination over the entire syllabus

The oral examination aims to verify the student's actual knowledge and acquisition of the theoretical notions relating to the topics covered in the syllabus.

By means of general theoretical questions, it will be ascertained whether the student is able to
- identify and define legal concepts using appropriate technical language;
- identify, distinguish, know, understand, interpret and apply, with a critical spirit and autonomy of judgement, both the regulatory provisions that make up criminal law, in all its forms and articulations, and the texts of some fundamental judgements, knowledge of which is indispensable for a complete view of the subject
