OVERVIEW

Knowledge of labor law is fundamental for those who intend to operate within companies (dealing in particular with the management of human resources) or obtain the qualification to practice the profession of labor consultant.

The course aims to provide adequate knowledge of the discipline of labor law.

The course provides the basic notions and interpretative tools essential for knowledge of the industrial relations system and for in-depth knowledge of the set of rules that govern the employment relationship.

PREREQUISITES

Have passed the preparatory exams.

Labor law and its historical evolution - From corporate law to trade union freedom - Art. 39 of the Constitution - The protection of trade union freedom and activity in the workers' statute - The prohibition of discriminatory acts and agreements - Trade unions of convenience - Trade union representatives in the company (RSA and RSU) - The common law collective agreement - Subjective effectiveness of the collective agreement - The mandatory nature of the collective agreement - The ultra-activity of the collective agreement - The company collective agreement - Relationships between collective agreements of different levels - Strike and lockout - Subordinate work and self-employment (including smart working, the work of riders) - Qualification techniques - Unavailability of the contractual type - Coordinated and continuous collaborations - Hetero-organised collaborations - The worker's obligations (obedience, diligence, loyalty) - Controls and confidentiality - Disciplinary power and its limits - Categories, qualifications, tasks, ius variandi - Transfer of the worker - Salary - Working hours, part-time, intermittent work - Fixed-term contract - Administration of work - Secondment - Tenders and work - Waivers, settlements, conciliation of labor disputes - Termination of the employment relationship ( individual and collective dismissals and resignations)

EXAM DESCRIPTION

The exam will consist in an oral test.

ASSESSMENT METHODS

The exam aims to verify the student's actual knowledge and acquisition of theoretical notions.
