OVERVIEW

The Public Administration, its organization and the principles and rules of its functioning. Evolution of the matter, and relationships with other branches of law. The Public Administration in the Constitution: the principles of administrative law. General profiles of the administrative organization: public subjectivity. The subjective legal situations and administrative powers. The instruments of administrative action: the administrative provision and administrative agreements. Notes on the administrative justice system.

AIMS AND CONTENT

LEARNING OUTCOMES

The purpose of the course of Administrative Law is to provide the knowledge bases on the principles and rules governing public entities, which regulate their organization, action and their interaction with private subjects and legal situations.

AIMS AND LEARNING OUTCOMES

The aim of the course is to provide an introduction to Italian administrative law, through the examination of the main institutions, both substantive and procedural, so as to enable an adequate understanding of the challenges that the Italian public administration is facing in the current historical phase.

Self-study, attendance and participation in the proposed training activities will enable students to: i) identify, analyse, understand and apply the sources of administrative law, both in the national and European perspective; ii) understand and analyse the main institutes of administrative law; iii) autonomously identify and critically assess the prospects for reform of the Italian public administration; iv) express in appropriate technical legal language.

PREREQUISITES

Knowledge of the basic principles of public law and constitutional law is necessary to adequately and effectively deal with the teaching content.

It is highly recommended to have previously passed Public Law exam or other similar teaching.

TEACHING METHODS

Lectures and exams will be held in presence.

All lecturer’s communication will be done via Aulaweb.

The course consists of lectures for a total of 36 hours (equivalent to 6 CFU). The lectures will be mainly face-to-face, but may also include textual analysis of normative and jurisprudential texts. The lectures will be held in Italian and will be supplemented by slides. Lectures, conferences and symposia on the subject may also be an integral part of the course, in which case they will be indicated by the lecturer in class and via AulaWeb.

Attendance is not compulsory, but there will be a special programme for attending students, which will be communicated in class.

  • historical introduction to Italian administrative law;
  • European and national sources;
  • constitutional principles;
  • legal relations under public law;
  •  administrative procedures;
  •  administrative acts;
  • administrative responsibility;
  •  administrative organisation;
  • public employment;
  • public goods;
  • administrative justice.

The study of the following volume is required for all categories of students:

Attending students should focus their preparation mainly on the lecture notes, slides and material provided from time to time on the Aulaweb platform.

EXAM DESCRIPTION

The final examination will take place orally.

Alternative ways of verifying learning will be indicated in class for attending students.

ASSESSMENT METHODS

The examination aims to ascertain: knowledge of the topics covered in the course, adequacy of expository order, and mastery of technical legal language.
