OVERVIEW

The Cultural Heritage Law course aims to provide a comprehensive examination of the regulation of Italian cultural heritage (including both cultural assets and landscape assets), from the perspective of the Code of Cultural Heritage and Landscape (Legislative Decree no. 42/2004), as well as international and European Union legislation. The course offers a study of domestic and supranational regulations, with particular attention to the most recent jurisprudential developments.

AIMS AND CONTENT

LEARNING OUTCOMES

The course focuses on the study of national and supranational legislation concerning cultural heritage, in its aspects as cultural assets and landscape assets. Particular attention will be given to the nature and implementation of the functions assigned to the Ministry of Culture, the Regions, and other territorial public bodies, as well as to the European Union and other international organizations.

AIMS AND LEARNING OUTCOMES

  • Acquire an in-depth understanding of the concepts of cultural assets, landscape assets, and the administrative procedures for declaration, verification, and imposition of landscape constraints;

  • Understand international and European Union regulations concerning the circulation and protection of cultural assets;

  • Know and comprehend the contributions of jurisprudence, particularly administrative case law;

  • Understand and use the terminology employed by the relevant public administration, especially the Ministry of Culture;

  • More generally, be able to describe the characteristics, procedures, and structures related to cultural heritage.

PREREQUISITES

For students enrolled in the Master's degree in Law: a good knowledge of the topics covered in the Administrative Law I course is required.

For students enrolled in the Master's degree in Art History: no specific prior knowledge is required. However, materials and documents will be provided during lessons to acquire the necessary notions of public law and administrative law (which are already possessed by those who have attended the Bachelor's course in Legislation for Cultural Heritage).

TEACHING METHODS

Theoretical lectures with references to case law.

The lectures will be balanced with the analysis of relevant real-life cases that have attracted judicial attention, involving students both individually and in groups. This will also include the use of major legal databases. Each group (or individual student) will be required to analyze a relevant case and develop and present a proposed solution.

Classes will be held in person.

Part One: Introduction to the subject and coordinates of administrative/public law;

Part Two: Cultural heritage, cultural assets;

Part Three: Protection, enhancement, and management of cultural assets;

Part Four: The landscape;

Part Five: Organization;

Further topics: Historic centers; intangible cultural heritage.

The recommended textbooks, at the student's discretion, are:

1. Barbati - Cammelli - Casini - Piperata - Sciullo, Diritto del patrimonio culturale, Bologna, Il Mulino, utlima edizione;

2. Crosetti - Vaiano, Beni culturali e paesaggistici, Torino, Giappichelli, ultima edizione.

Preparation will also be based on the materials provided by the instructor on Aulaweb.

EXAMS

EXAM DESCRIPTION

The exam is oral or, at the discretion of the examination board, both written and oral.

Any interim assessments will be agreed upon with the students and reserved for those who have attended at least two-thirds of the classes.

ASSESSMENT METHODS

Several open-ended questions requiring reasoned answers will be asked on each part of the course.

Assessment criteria:

  1. Appropriateness of the legal terminology used;

  2. Consistency of the answers with the educational objectives and learning outcomes.
