OVERVIEW

The subject is the study of private law, in all its main aspects and problems.

AIMS AND CONTENT

LEARNING OUTCOMES

The course aims to provide knowledge of the fundamental institutions of private law. In addition to the fundamental legal notions, the subject of obligations and contracts, property rights and liability are the subject of particular study.

AIMS AND LEARNING OUTCOMES

The course aims to provide students with basic notions of private law, with particular regard to the following topics:

- Private law in the legal system

- The sources of private law

- Legal situations and their circolation 

- Property and assets

- The subjects of law

- Rights on things 

- Obligations

- The contract in general

- Typical and atypical contracts

- Tort Law

- Market regulation

 

Individual study and active attendance of lectures and training activities offered will allow students to:

- Understand and remember the main regulatory provisions governing private law;

- Identify, understand, and apply the rules of private law;

- Understand the structure and functioning mechanisms of private law, thus becoming aware and critical of the problems of application;

- Read and critically examine legislative texts, doctrinal contributions, jurisprudential cases;

- Express themselves in an appropriate technical and legal language.

TEACHING METHODS

Face to face lectures, also online for those students who, having informed the Professor, cannot attend the lecture for good causes.

RECOMMENDED READING/BIBLIOGRAPHY

1) V. Roppo, Diritto privato. Linee essenziali, Torino, Giappichelli, last edition available: all, except chapters 43 and 44. 

2) Codice civile. Per la didattica e lo studio, Torino, Giappichelli, 2022 (II edition).

Every other publication of the Italian Civil Code and the main statutes is equally appropriate.

EXAM DESCRIPTION

Oral examination. 

Students who have duly filed a recommended certification of DSA, disability or other educational needs special requests should contact both  Prof.ssa Arianna Pitino (arianna.pitino@unige.it) and Prof. Edoardo Pesce at the beginning of the course, in order to define teaching and examination methods which, in compliance with the teaching objectives, take into account the methods of individual learning and provide suitable compensatory tools. 

ASSESSMENT METHODS

The oral exam aims to verify the student's actual knowledge and acquisition of the basic theoretical notions, as well as his or her ability to use properly the legal language.
