The course includes an in-depth study of port regulations. The course is essential for students who intend to work in the future for companies or public bodies operating in the shipping and transport sectors, or to pursue careers related to these fields. AIMS AND CONTENT LEARNING OUTCOMES At the end of the course, students will acquire the methodological tools and specific skills in the field of law of navigation, specifically in the context of the national and international regulations, as well as in respect of standard contract forms adopted in the practice of international maritime trade, and will be able to understand and analyze current legal issues, as well as to independently apply the notions acquired to practical scenarios. AIMS AND LEARNING OUTCOMES The course aims to provide students with an adequate knowledge and understanding of the legal principles and the regulatory framework governing the subject. Through independent study, attendance and participation in the teaching activities offered, students will be able to: • Identify the rules applicable to cases in maritime law, understand how they operate and apply them to the resolution of specific cases; • Argue using the legal principles learnt, distinguish between specific cases and make connections between legal categories and institutions; • Conduct research into national and supranational case law and analyse the reasoning behind decisions relating to maritime law issues; • Understand the legal rationale underlying contractual practices in maritime trade; • Critically and independently evaluate legislative policy choices concerning maritime law; • Identify and analyse current issues relating to developments in the field; • Express themselves using appropriate legal technical language; • Clearly illustrate and explain what they have learnt. PREREQUISITES There are no specific requirements. TEACHING METHODS The course consists of lectures, totalling 36 hours (equivalent to 6 CFU). Attendance at lectures is not compulsory but is strongly recommended. During the lectures, a number of real-life cases decided by national and supranational courts will be presented, and these will be discussed in depth with the active participation of the students. SYLLABUS/CONTENT • the sources of maritime law (international law, European Union law, national law and private autonomy) and the rules of private international law applicable to maritime navigation; • the maritime domain, ports and port services; • the assets and parties involved in maritime trade (ships, shipowners, masters, crews and shipping auxiliaries); • maritime incidents (collisions, rescue operations, general average); • maritime contracts; • maritime insurance. Class schedule NAVIGATION LAW EXAMS EXAM DESCRIPTION The examination consists of an oral interview designed to assess the knowledge the student has acquired in relation to the entire course syllabus. ASSESSMENT METHODS The oral examination aims to assess the student’s actual knowledge and mastery of the basic theoretical concepts, as well as their ability to identify and apply the relevant legal provisions to specific practical cases. Through questions of a general theoretical nature and the presentation of practical cases and problems, the examination will assess whether the student is able to: • identify and define legal concepts using appropriate technical language; • identify and apply the main statutory and contractual provisions governing relationships relating to maritime law with reference to specific cases; • understand and interpret, with a critical eye, the main statutory and contractual texts, as well as the texts of certain key judgements; • effectively illustrate and explain the concepts learnt.
