OVERVIEW

The course focuses on certain fundamental aspects of property rights, paying particular attention to the connection between the Civil Code and the Italian Constitution, as well as the current problematic junctures posed by, on the one hand, the so-called commons, and, on the other, the relationship between private autonomy and the social function of private property.

 

AIMS AND CONTENT

LEARNING OUTCOMES

The module has two main formative objectives: i) a sufficient knowledge of the discipline of property rights and contracts, contained in the third and fourth book of the Italian Civil Code; ii) a critical analysis of some open problems, because of the indispensable connection between Italian and Euro-Unitarian regulations. In this second profile, the analysis of some judicial materials, carried out collectively in the classroom, is aimed at the development of an autonomous critical spirit in the face of some fundamental legal problems in the subject matter that constitutes the object of the course.

AIMS AND LEARNING OUTCOMES

The goal of the course is to help students understand the general principles of the subject, so that they can independently apply the knowledge they have acquired, including through critical analysis.

Furthermore, based on the cross-disciplinary skills included in the learning objectives, students will develop the ability to communicate effectively in both written and oral forms, adapting their communication to the context and using a variety of sources and resources.

Students will also refine their critical thinking and their ability to use, process, and evaluate information, with particular emphasis on argumentation skills.

TEACHING METHODS

Lectures, with group discussions in the classroom, aimed specifically at developing transferable skills focused on the ability to engage in dialogue and present arguments.

SYLLABUS/CONTENT

The course focuses on Book Three of the Civil Code (and, in part, on Book Six).

Specifically, the following legal concepts will be analyzed: ownership, minor rights in rem relating to enjoyment, minor rights in rem relating to security, co-ownership, condominium ownership, possession and detention.

The exam consists of a written and an oral portion: three open-ended questions followed by a brief interview.

ASSESSMENT METHODS

The written exam assesses students' logical and argumentative skills; the oral exam assesses students' ability to present and discuss ideas.
