OVERVIEW

The Course introduces students to the knowledge of the basic items of maritime and shipping law.

AIMS AND CONTENT

LEARNING OUTCOMES

The aim of the course is to introduce the students to the knowledge of the basic rules and documents concerning the shipping field, particularly with reference to the ships and the navigational system regulations, as well as the modern uses of the vessels - including specific focus on some items such as safety and security in the navigation and maritime carriages of goods and containers - through an analysis of the relevant national, international and EC Laws and Rules.

AIMS AND LEARNING OUTCOMES

It’s assumed that at the end of the Course students will be acquainted with the fundamental principles of Maritime and Shipping Law and will be able to elaborate them, having reached a good knowledge of the relevant legal problems and a skill to come to concrete solutions. It’s also assumed that students shall be able to communicate their knowledges and results in a clear way and that they shall be able to develop and implement their knowledges on the proposed items by themselves.

TEACHING METHODS

The Course is based on traditional lessons as well as on seminars and/or mettings aimed at the study of specific topics and also on testimonials from maritime operators.

Students’ participation is encouraged.

Part I (prof.ssa Monica Brignardello):

  • Legal sources of maritime and shipping law
  • Organisation of the maritime administration
  • Maritime domain
  • Ships
  • Shipowner
  • Maritime Safety and security
  • Coastal and Port State Control
  • Maritime Zones and Coastal and Flag State Rights

Part II (prof.ssa Giorgia Boi):

  • Maritime Contracts as source of legal regulation: conditions of applicability in maritime field.
  • The shipping Operators: Shipowner, Shipmanager, Master, Vessel’s Agent, Broker, Carriers, NVOCC carriers, Forwarding Agent, multimodal and logistic Operators
  • Ships and property:
    - Shipbuilding contracts
    - Ship Sale contracts
  • Contracts for the ship’s uses:
    - Bareboat charter and Vessels’ Leasing contract
    - Time charter, Voyage charter, Contract of affreightment, Service contract
    - Carriage of goods by Sea in national and international traffics; the 1924 International Brussels Convention on Bills of Lading: Carriers’ obligations and liabilities, Claims for damages or losses to the Goods
    - Carriage of  Dangerous Goods (IMDG Code)
    - Multimodal Transport of Goods and main regulations
  • Containers uses and rules on carriages of containers
  • Shipping Documents (Charterparties, Bills of Lading, Seawaybills, etc.)
  • Customs principles in the maritime Carriage of Goods
  • General Average
  • Salvage at Sea

The Course includes also a part on pleasure vessels’ and crafts’ rules.

ASSESSMENT METHODS

The exam aims to verify students’ learning skills, in-depth knowledge and understanding of the fundamental principles of Maritime and Shipping Law, understanding of the relevant legal problems, abilities to come to concrete solutions as well as their communications skill.
