The course covers the study of Italian constitutional law with particular attention to the system of sources and the issue of rights.

AIMS AND CONTENT

LEARNING OUTCOMES

Learning outcomes are the following: (a) understanding the basic concepts concerning the Italian public law; (b) dealing with such concepts with regard to social services; (c) using legal Italian properly.

AIMS AND LEARNING OUTCOMES

The teaching provides the basis for the study of the other matters included in educational offer of the three-year degree course in Social Service; it is also correlated with the other teachings of the course, with particular regard to those taught in the first year, contributing to the interdisciplinary education of students.

The educational objectives of the course are to enable first-year students to: a) understand the functioning of the fundamental institutions of Italian public law; b) apply this knowledge to the specific areas of public law related to social services; c) acquire the essential legal language and mindset.

At the end of the study of the matter Public law, students will be able to:

a) understand and comment on Italian Constitution,
b) to recognize the sources of Italian law, also in relation to the sources of international law and sovranational law.
c) understand the relations between the constitutional organs of the State,
d) understand the relationships between jurisdictions,
e) to know the territorial articulations of Italian State,
f) read and distinguish between the different types of judgments of the Constitutional Court,
g) dentify the tools of protection of the fundamental rights of the person,
h) nderstand the basic methods of functioning of Italian public administration.

The course on Institutions of Public Law aims to provide basic knowledge of public law, with a particular focus on the constitutional organization of the State, the sources of law, and the system of regional and local autonomies.

The course will enable the student to:

- acquire basic knowledge of the concepts and legal categories of public law;

- understand the organization and structure of public powers, the relations between constitutional bodies, the judicial system, and the protection of liberties and fundamental rights;

- identify the sources of law and develop the ability to interpret legal norms;

- understand the relations between the State, Regions, and the European Union;

- acquire legal methodology and linguistic proficiency in the field of public law.

TEACHING METHODS

The course consists of frontal lectures, totaling 36 hours (equivalent to 6 ECTS), during which the program’s topics will be analytically presented. Some lectures, which may take on a seminar format, will be held by the lecturer, possibly together with Italian or foreign experts, to explore topics of particular interest or relevance.

The program of the Public Law Institutions course includes the study of the following topics:

- The notions of law and the State;

- The Constitution and the system of sources of law;

- An overview of the forms of State;

- The relations between the State, the European Union, and the international legal system;

- The rights and duties of citizens and individuals, with particular regard to the right to health and social assistance rights;

- The organization of the Republic: constitutional bodies and their functions;

- Constitutional guarantees: the Constitutional Court and the constitutional revision procedure;

- Regions and local autonomies.

TEACHING METHODS

The lessons of the course will be held by the professor and some presentations will be given  by experts (judges, professors of other universities, members of the institutions, etc. ...). invited to deepen specific topics. 

For FOREIGN students (non-native Italian speakers who have not completed education cycles in Italy), in addition to the institutional course, meetings will be organized to discuss the topics already discussed in the main course, with particular attention to the meaning of the terms and features of public law in Italian language.

Students are recommended to register for aulaweb, where all information, teaching materials and exam results will be uploaded.

A list of possible exam questions will be made available on Aulaweb at the end of the lessons.

notions of law and of State;

Constitution and the system of sources of law;

relations between the State, European Union and the international system;

rights and duties of citizens;

organization of the Republic: constitutional bodies and their functions; ordinary and special judges; constitutional guarantees: the Constitutional Court and the constitutional review procedure; Regions and local autonomies;

The study should be accompanied by a careful reading of the Italian Constitution ((downloadable from www.quirinale.it).

Teaching materials (slides used by the lecturer in class, normative materials, handouts and texts subject to further study) will be available on the Aulaweb platform.

Alternative volumes for foreign students will be pointed out by professor at the beginning of class. Additional in-depth texts will be pointed out in the course of teaching.

EXAMS

EXAM DESCRIPTION

Students will have to register for the exam, within the specified time using the relevant UNIGE digital tool. Failure to register will exclude the participation to the test. For documentation purposes only, the student is advised to print the receipt of registration.

Registration is open up to two business days prior to the exam date.

Please remove your name from the exam registration, otherwise students registered for the exam who do not show up are recorded as “absent.”

The examination is in written form and consists of 31 questions. The mark  is the result of the correct answers.

Students who pass the written test may request to take a supplementary oral test (by which they can improve or worsen the grade already achieved in the written): it will take place at the location and time indicated on the day of the written test. If the student does not wish to take the supplementary oral test, the examination is concluded with the written test.

Students with certification of DSA, disability or other special educational needs should contact the teacher at the beginning of the course to agree on teaching and examination methods that, while respecting the objectives of the teaching, take into account individual learning modes and provide suitable compensatory tools. ASSESSMENT METHODS

The Examining Board will evaluate the consistency and completeness of the answers, the use of the correct legal terminology, the ability to make connections between the various parts of the matter. The frequency and active participation in the lessons will be evaluated

FURTHER INFORMATION

Students are encouraged to register for the teaching on Aulaweb.

Status of attending student It is considered an attending student who is regularly enrolled and has attended at least 2/3 of the lectures. Attendance is ascertained through geolocation on the Unige app.

Attending student status is valid from the December roll call until the September roll call following the end of the course.  The list of attending students is made known via web classroom.In compliance with the University Teaching Regulations: Students with disabilities and students with specific learning disorders (D.S.A. ) are allowed equivalent tests and longer time for taking written or graphical tests and the presence of personal assistants, Italian sign language interpreters, communication assistants and tutors, verified and approved by the University, for autonomy and/or communication in relation to the degree and according to the type of disability and/or specific learning disorder. Students with disabilities take examinations with the use of aids necessary to them. The University guarantees specific technical and educational aids, as well as the support of specialized tutoring services on the basis of available financial resources. Individualized treatment in favor of students with disabilities and students with specific learning disorders (S.D.A.) is allowed for passing examinations upon agreement with the subject teacher, the school’s liaison teacher or the rector’s delegate for university inclusion of students with disabilities and S.D.A.
