    OVERVIEW

    The Course of institutions of public law focuses on the fundamental institutions of Italian public law.

    In particular, the subject of the course will be the disciplines relating to the organization of the State, territorial autonomies and the constitutionally relevant subjective situations of resident or resident citizens and non-citizens, in light of the constitutional and implementing provisions, with the necessary references to international and European Union law.

    AIMS AND CONTENT

    LEARNING OUTCOMES

    Learning outcomes are the following: (a) understanding the basic concepts concerning the Italian public law; (b) dealing with such concepts with regard to social services; (c) using legal Italian properly.

    AIMS AND LEARNING OUTCOMES

    Attendance, active participation in lessons and individual study will allow the student to:

    Understand the functioning of the fundamental institutions of public law, with particular attention to the organization of public powers, the system of sources and rights in general, with a specific focus on the right to health and the right to social assistance;

    Use this knowledge with reference to the specific social service sector;

    Identify the main public sources of the Italian legal system and understand their application scope;

    Understand the structure and functioning mechanism of the Italian constitutional and administrative system and be aware of the meaning and relevance of individual rights;

    Acquire the essential legal language and mindset; Critically evaluate historical-legal and political-social current affairs.

    PREREQUISITES

    Basic knowledge of Italian history and current political events.

    TEACHING METHODS

    The teaching consists of frontal lessons, for a total of 36 hours (equal to 6 ECTS).

    In the first part of the course, we will focus on illustrating the fundamental institutions of Italian public law, with particular attention to the organization of public authorities and the system of sources.

    In the second part of the course we will focus on rights in general and in particular on the right to health and the right to social assistance.

    Students are recommended to register on Aulaweb, where the materials relating to the teaching and any notices will be uploaded (for example, the postponement of the date of an exam). Interested students, in agreement with the teacher, will also be able to propose and present to the class sentences or other issues for further investigation.

    Students with certification of DSA, disabilities or other special educational needs must contact the teacher at the beginning of the course to agree on teaching and examination methods which, in compliance with the teaching objectives, take into account individual learning methods and provide suitable compensatory tools.     Occasionally, officials, scholars and experts may be invited to give a lesson on topics of particular interest and current affairs, also in order to allow students to acquire greater awareness of the concrete and applied dimension of the subject.

    The teaching program of public law institutions includes the study of the following topics:

    The State and public bodies;
    The constitutional organization in Italy;
    Regional and local government organisation;
    The public administration. Administrative acts and measures;
    The sources of law;
    The protection of rights: judges and the Constitutional Court;
    Constitutional rights;
    Focus on the right to health and the right to social assistance;

    The exam takes place in oral form.

    ASSESSMENT METHODS

    During the final exam, students will be invited to answer a certain number of questions on any part of the program in order to verify the knowledge acquired and the ability to orient themselves in the subject.

    The correctness and precision of the presentation, the appropriate use of legal vocabulary and, in particular, the ability to critically reason with regard to the topics studied will also constitute evaluation parameters.

    In any case, it is understood that the final grade of the exam will be defined on the basis of a balanced and thoughtful evaluation of the overall preparation (very serious gaps or misunderstandings, for example, not being able to be "compensated", in principle, by the good outcome of the exam exam on other parts of the program). As part of the aforementioned evaluation, the degree of depth of the study will also be taken into account, especially if carried out also through regulatory or jurisprudential materials uploaded by the teacher on aulaweb.
