The topics that will be discussed during the course will also be analyzed through the exam of specific case studies and their court judgments. AIMS AND CONTENT LEARNING OUTCOMES The "Legislation of cultural heritage" course gives students an overall view of the subject of cultural heritage in accordance to the Legislative Decree n. 42/2004, as subsequently amended and supplemented. It will also provide the necessary prerequisites to frame the discipline also in a diachronic key with comparative openings and to international and European Union law. AIMS AND LEARNING OUTCOMES The teaching in “Legislation of Cultural Heritage”, first of all, aims to give to the students good general knowledge of all aspects linked to cultural heritage and property heritage: public domain, private goods, movable or immovable assets, material and immaterial heritage, historical archives and libraries, archaeological heritage, architectural heritage. Secondly, the course examines the most important rules in protection and valorisation of Italian cultural property in order to enable all students to solve some of the most rilevant legal dispute about cultural property. At the end of the course, the students will be able to manage the most relevant notions about public and administrative law. They will also be able to describe all the institutions of the “Legislation of Cultural Heritage” and to relate them to the administrative procedures held by public administrative bodies in the cultural heritage field. TEACHING METHODS Classes are held in presence. Attendance, although not compulsory, is recommended. The lecturer, at the specific request of a student (by e-mail), may allow him/her to follow classes remotely via “Teams” platform. Teaching materials will be uploaded on “Aulaweb”. For this reason, all students are invited to register on the Aulaweb page “Legislazione per i beni culturali”. SYLLABUS/CONTENT The teaching program is scheduled on five sections: 1. Notion of cultural heritage; 2. Italian legislation on cultural heritage (legislative decree no. 42/2004); 3. Cultural heritage administrative organisation with a focus on, the Italian Ministry of Cultural heritage, cultural activities and tourism; 4. Administrative procedure in cultural field; 5. If the number of the candidates is too high, a final oral test might be preceded by a written part ASSESSMENT METHODS The evaluation will take into account different aspects and the final marks will be on a 30-point scale that can be divided into failing (0 to 17) and passing (18 to 30 cum laude) grades: 1. A deep knowledge of the recommended book and of the materials provided by the professor, the use of the proper technical and juridical terms (final grade: from 28 to 30 cum laude); 2. The knowledge of the books and the materials foreseen for the exam, decent analytical skills, the mostly correct use of the technical language (final grade: between good (25-27) and satisfactory (23-24)); 3. An uncomplete and basic knowledge of the recommended books and the sometimes unproper use of some technical expressions could be considered as sufficient (final grade: from 18 to 22); 4. Serious gaps of the topics explained in the recommended books, the lack of use of technical terms and the lack of the analytical skills will bring to a negative result of the exam (final grade: failed). Students who have valid certification of disability or Specific Learning Desorders (DSA) on file with the University may request the use of compensatory measures during the exams (e.g. additional time, concept maps, modifications in the written/oral mode), following the guidelines (p. 5) published here.
