OVERVIEW

The course deals with the discipline of the business crisis contained in the Italian Code of Crisis and Insolvency and in the complementary laws.

LEARNING OUTCOMES

The course aims at clearing up notions about bankruptcy law with particular attentionto new insolvency procedures. The course includes an illustration of practical cases aimed at providing students witha practical background.

The course aims to provide students with theoretical and practical knowledge that will enable them, in their future work, to (i) structure the business activity from an administrative and accounting point of view in order to detect any warning signs of crisis in good time; (ii) identify the existence of warning signs of crisis in practice; (iii) identify the most appropriate crisis resolution/debt restructuring tool in order to overcome it; (iv) understand the legal aspects of the various restructuring and debt tools offered by the legal system; (v) understand the content of liquidation proceedings in cases where it is not possible to continue business activities.

 

Expected learning outcomes

Knowledge and understanding. Students must acquire adequate knowledge and an effective understanding of the disciplines of corporate crisis.

Ability to apply knowledge and understanding. Students must be able to apply the knowledge acquired to behave appropriately in their future working life.

Autonomy of judgement. Students must be able to use the knowledge acquired both conceptually and operationally, with independent assessment skills and ability in different application contexts.

Communication skills. Students must acquire the technical language typical of the discipline in order to communicate clearly and unambiguously with specialist and non-specialist interlocutors.

Learning skills. Students must develop adequate learning skills that enable them to continue to explore the main topics of the discipline independently, especially in the working contexts in which they will find themselves operating.

PREREQUISITES


 

The teaching requires knowledge of Commercial Law, an exam taken in the three-year degree course.

TEACHING METHODS

 

 

Teaching is delivered through lectures and in-class discussions of case-studies. Students with valid certifications for Specific Learning Disorders (SLD), disabilities or other educational needs are invited to contact the teacher and the Department's disability liaison officer at the beginning of the course to agree on any teaching methods that, in accordance with the teaching objectives, take into account individual learning styles.

Oral exam. Students can take the exam in any exam session.
