OVERVIEW

The teaching concerns the regulatory framework about substatal territorial bodies in Italy: Regions and local bodies.

AIMS AND CONTENT

LEARNING OUTCOMES

The teaching illustrates Italian autonomic system, articulated in Regions and local bodies (Provinces, Metropolitan Cities and Communes), in order to enlight the analogies and the differences of their framework, especially from the organizational and the functional points of view.

LEARNING OUTCOMES (according to the Dublin descriptors)

1. Knowledge and understanding: The student will be able to describe and explain the main features of Regions and local bodies (content) after attending lessons and studying the materials indicated by the professor (condition).

2. Applying knowledge and understanding: The student will be able to apply the acquired knowledge to solve practical cases related to Regions and local bodies (content) during exercises and written tests (condition).

3. Making judgements: The student will be able to critically evaluate problems related to Regions and local bodies (content) using the acquired knowledge autonomously, both in academic and professional contexts (condition).

4. Communication skills: The student will be able to use the technical language of the discipline (content) to communicate clearly and unambiguously with both specialist and non-specialist interlocutors, both orally and in writing (condition).

5. Learning skills: The student will be able to autonomously deepen the main topics of the discipline (content) using normative sources and jurisprudence, especially in working contexts (condition).

 

 

PREREQUISITES

Having passed at least an exam in public law, constitutional law, public comparative law

TEACHING METHODS

The teaching will be done in presence or, in case of sanitary emergency, ai distance at the link that will be indicated on Aulaweb; lessons will be synchronous, without recording.

The teaching has 36 hours: many lessons will be held by the professor about the general aspects of the matter, some lessons will be held by experts about particular issues; students may deepen topics of their specific interest and the result of this activity will be considered during the examination.

Organs of the Region and regional form of government

Legislative, administrative and financial autonomy of Regions

Controls upon Regions

Litigation between State and Regions

Regulation about local bodies

Organs of the local bodies

Administrative and financial autonomy of local bodies

Controls upon local bodies

Relations between State, Regions and local bodies

Italy as a regional, autonomistic State; differences from federal States and from other regional States

The texts will be indicated at the beginning of the lessons and on Aulaweb.

EXAMS

EXAM DESCRIPTION

The exam will be held in verbal form, in presence; in case of health emergency, online on teams.

The exam will consist in three questions about the different topics of the teaching

ASSESSMENT METHODS

 

Each learning outcome will be assessed through open-ended questions requiring the student to:

1) describe and explain fundamental institutions (knowledge and understanding):

2) apply knowledge to practical cases (apply knowledge and understanding);

3) critically evaluate legal situations (making judgements);

4) use technical language clearly (communications skills);

5) autonomously deepen topics of the discipline (learning skills).

The assessment criteria include completeness, accuracy, clarity of exposition, critical ability and connection to the general principles of law.

Students having depositate regular certification of DSA, disability or special educational needs are invited to contact the referent of the Department  prof. Aristide Canepa (aristide.canepa@unige.it) and the professor, at the beginning of the course, to agree teaching and exam modalities that take into account individual learning methods and provide suitable compensatory tools.
