    OVERVIEW

    Diritto Privato Comparato A-L is organised in two halves. After a brief introduction on legal comparison, lectures will focus on principal legal orders of both civil law and common law areas. In each semester legal sources (especially judgments) will be studied in their own languages

    Students will be encouraged to reflect on the critical aspects of the topics covered, with the aim of developing the ability to identify and describe the differences that emerge alongside the main private law institutions of the Italian legal system, as compared to those of other European countries.

    Reference to specific foreign legal provisions will allow students to become familiar with the legislative and interpretive choices made in the legal systems examined. Comparison with common law systems will enable students to identify unexpected cultural affinities hidden behind apparently distant technical divergences, recognising convergences in operational solutions similar to those found in continental European legal traditions.

    Knowledge of at least one of the following languages: English, French, German.

    SYLLABUS/CONTENT

    PThe second module focuses on the in-depth comparative analysis of specific topics in private law, including, in particular: personality rights, non-profit entities, family and succession law, property and real rights, contract law, and the organisation of the legal profession. The module traces the evolution of these areas over recent decades in both continental European law and in English and American law.

    EXAM DESCRIPTION

    Although divided into modules, the course is assessed as a single unit. The examination is therefore taken in oral form at the end of the lectures of both modules, during the regular examination sessions.

    N.B.: Students are considered attending if they have participated in at least 2/3 of the total lectures. Attendance will be verified through periodic roll calls.

    ASSESSMENT METHODS

    The oral examination is designed to assess the student's ability to discuss the main private law institutions from a comparative perspective using appropriate legal terminology, to compare the legislative and interpretive choices made in the different legal systems examined, and to engage in critical argument on the topics covered in the programme.

    Students having a valid certification of disability, Specific Learning Disorders (DSA) or other educational needs (BES) and having complied with Unige procedures (described here) may request the use of compensatory measures during the exams (e.g. additional time and/or concept maps).
