The course deals with the discipline of the business crisis contained in the Italian Code of Crisis and Insolvency and in the complementary laws.
The course aims at clearing up notions about bankruptcy law with particular attentionto new insolvency procedures. The course includes an illustration of practical cases aimed at providing students witha practical background.
The course aims to deepen: 1. the regulation of traditional bankruptcy procedures (liquidazione giudiziale, concordato preventivo, amministrazione straordinaria, liquidazione coatta amministrativa); 2. crisis settlement tools and procedures (composizione negoziata, piani di risanamento, accordi di ristrutturazione dei debiti, piani di ristrutturazione omologati, transazione fiscale); 3. of the tools and procedures for the settlement of the over-indebtedness crisis in favor of the non-business debtor.
The course requires knowledge of Commercial Law, an exam taken in the three-year degree course.
